Adrian Gonzalez was given a maximum sentence in jail after admitting to all charges in connection to the kidnapping, rape, and murder of 8-year-old Maddie Middleton more than five years ago.
Gonzalez, who is now 21, could be released from the juvenile justice system when he turns 25.
Gonzalez entered his guilty plea in mid-April after his case was handed down to juvenile court after a state supreme court decision earlier this year upheld a state law preventing anyone under 16 from being tried as an adult. Gonzalez was 15 when he murdered his young neighbor, just three months shy of turning 16.
When Adrian Gonzalez turns 25 there’s no guarantee he’ll be released from the juvenile justice system. The court can be petitioned to extend Gonzalez’s time in custody.
SB 1391
In 2019 SB 1391 was ruled unconstitutional by a Santa Cruz County Superior Court judge before it was taken to the state supreme court.
In 2020, lawyers argued before the state supreme court on the constitutionality of the law. Some argue it's unconstitutional because it overrides the will of the voters who passed Proposition 57 allowing judges not prosecutors to decide whether minors, including 14 and 15 year olds, should be tried as adults.
“We believe that the California juvenile system, as it stands today, cannot deal with a person such as Adrian Gonzalez we feel that he has to remain in the adult system in order to take care of him. He is not an innocent child that should be coming out when he's 25 years old,” said Dan Middleton, Maddy’s grandfather, in an interview with KSBW 8 in November 2020.
But supporters of SB 1391 argue that prosecutors are politicizing the law and they say juvenile offenders no matter how egregious the crime they allegedly commit should remain in juvenile court where they qualify for release at age 25.
Gonzalez has remained behind bars in the Santa Cruz County jail.
Released into the arms of her relatives I would hope.
Some families would not need for him to be released into their “loving” arms. They’d bide their time, keep quiet and strike at an appropriate time leaving ZERO trails.

As I was saying. Anyway, a divergent. I read awhile back where this guy who just finished serving fifteen years in prison was released and as he was walking to a car to pick him up another car came by and shot him down. Fifteen years later. Somebody held a grudge for a long time.
Did they know what the grudge was about?
Dunno - I just read where this guy was released after fifteen years and when he walked out he was gunned down. OTT I have no idea of what the revenge was all about.
15 years is not a long time to wait for true justice when some POS murdered a family member. I’d gladly be patient for longer than that.
The only thing better would be if they dragged him two or three miles with a light chain.
He did an adult crime and should be given adult time. Sicko will get out and do the same within six months to someone else’s little daughter. Child molesters can not be cured.
One suspect was arrested, but there were problems with the evidence. Ten years later, there were doubts it would ever reach prosecution.
In 2011, the suspect ran into the woman's brother in a Red Robin. The brother left, the came back. The suspect walked to Pete's Coffee, and the brother followed, where they talk some more.
Then the brother shot the suspect dead, went back to the car and shot himself.
Because of the incident, they did a test matching the the suspect's car with the victim's missing rug. So the case was closed, because he was dead.
But when the brother shot his sister's murderer, he thought the killer would never be punished. And maybe he never would have been.
A relative of mine went to school with the brother and knew the whole family.
Interesting.
One tragedy begets another.
