I'm not sure about the Oklahoma Felony embezzlement statute, but I think most criminal codes regarding theft of property require the intent to permanently deprive the rightful owner of use or access to the property in question. From her account in the article, the tape was apparently rented by a former shack up, and she was not even aware of it, so if indeed the intent is an element of the crime, the DA would have had a tough hill to climb in prosecuting the case. In as much as the DA is probably elected, he was also wise to drop it, as any opponent in an election would beat him over the head for having pursued this.

If on the other hand, the tape was rented on her account with the store, and her membership agreement detailed the accrual of late fees, this could have been an interesting civil case had the store not gone out of business and chose to pursue it.

I have a feeling there is more to the story. Like when a reporter says, “man receives life sentence for burned out brake light” not mentioning their was a duffel bag full of human heads in the trunk.
