The Justice Department, within 60 days, will issue a proposed rule to make clear when a device marketed as a stabilizing brace effectively turns a pistol into a short-barreled rifle subject to the requirements of the National Firearms Act.So, an AR Pistol, like the one pictured below will now require a $200 stamp.

IMHO, this will unfortunately survive all court challenges.
The big question is whether the BATFE will force current owners to purchase a stamp or turn in their AR pistols.

My AR pistols were built from Form 4473 stripped lowers and use a naked buffer tube, no braces ever. Pistol uppers were purchased. I can just re-barrel the uppers with a 16.1" barrel, new gas block and gas tube. The only "waste" in the process in the pistol length forends and barrels. Pistol lowers will get a rifle buffer tube and Magpul stock.
I have two NFA SBRs with ATF tax stamps. They will remain as-is. There will be no "turning in" of property, just updating to remain non-NFA and ATF compliant. The sad part is I've never fired a single round out of the pistol uppers. They are NIB.

You could just remove the brace.
