I’m dating a married man. He made me the beneficiary on a $100K life-insurance policy. Could his wife sue to claim this money?

Dear Quentin,

I live in Utah, and I have been seeing a married man for almost six years. No, I’m not ashamed. Although we both care greatly for each other, our relationship started as and remains a mutually beneficial one: money for me, companionship for him.

He has been my sole source of income for the last 5 years, paying every single expense I have, and he is happy to do so because he loves me and I provide an escape from his miserable home life (his words). He’s been married a long time, and his only child is grown.

He is much, much older than I am, and he recently set up a life-insurance policy of $100,000 with me as the beneficiary. His wife knows nothing of me or the policy. We’ve taken steps to ensure I can get a copy of his death certificate without his family knowing.

He is mentally sound (always has been) and in great health. I need to know if his wife would have any claim to that policy should she discover it after his death. What is the likelihood a lawsuit would be in her favor if she sued? Does it matter who makes the payments on the policy?

There’s an old school here and the guy that owned the property died and when they read the will, he had left it to a woman other than his wife. That’s how the wife found out he had been cheating on her.

My brother had me listed on two small insurance policies that he bought when single, and never changed it. So when he died, I got the money.
(I gave his wife half of the money to be fair)

As far as I’m concerned the only one who would say that is someone who has a lot to be ashamed of.

The money isn’t part of his estate if paid out to the mistress, so the wife is not entitled to it.

That’s her in front of the steps of the Citicorp building NYC. Racoon coats were in then, but were so heavy.

At least Rockefeller got her a co-op filled with art and a 60k year job for a 23 yr old. All Bill gave Monica was a stain on her blue dress.

Not to mention a very valuable piece of real estate in prime mid-town Manhattan.

Currently that address, 25 W. 54th St. is a luxury high rise with apts at about a million.

Imagine what her townhouse sold for.

The thing is...in an equitable division state, the estate is divided. Insurance proceeds are not part of the estate. That is how millionaires can pass money onto their children and heirs.

Insurance is paid to the beneficiary outside of probate.

This is basic estate planning. Old us old bastards should know this.

But an insurance payout isn’t inheritance. It’s a contract payout.

Not very emotional...but insurance policies are used to avoid probate every single day.
