Gov Noem is absolutely correct. Tucker, Bongino, The Fderalist, etc. all had knee-jerk reactions to MSM coverage of her letter. They never read her letter on air and discussed it. They just called what she wrote and said “caving to the NCCA”, etc. That is Cancel Culture.
From her letter:
For example, Section 2 of House Bill 1217 requires a student athlete to verify, each year, that the student “is not taking and has not taken, during the preceding twelve months, any performance enhancing drugs, including anabolic steroids.”
Presumably, this requirement was included to address a student taking these drugs as a part of a gender transition, but House Bill 1217 is not limited in this way. Rather, if a male student athlete failed to make the football team, and later learned that another student on the team was taking steroids without disclosing it, the student who didn’t make the team would be entitled to sue both the school and the steroid-using student for damages.
In addition, Section 2 creates an unworkable administrative burden on schools, who under its terms must collect verification forms from every student athlete, every year, as to age, biological sex, and use of performance-enhancing drugs; and furthermore must monitor these disclosures throughout the year so that if “reasonable cause” is found of a false or misleading form, the school can take action to avoid civil liability.

I’ll admit to being a little befuddled by the explanation here by South Dakota Governor Kristi Noem. The SD legislature passed a bill to protect women’s sports by banning biological males from participating in biological women’s sports. The bill has overwhelming support in South Dakota; however, Govenor Kristi Noem doesn’t support it.
When asked why she doesn’t support it, Noem seems to say she has received advice and counsel that the law would fail if challenged in federal court. Specifically Noem implies the NCAA would sue South Dakota and she believes the state would lose a lawsuit based on the law. If that is her position, essentially she is attempting to avoid litigation, proactively planning to lose that litigation, on a law supported by the majority in her state. WATCH:

Even if she is right on the substance of her legal position, she’s flat-out wrong to go after “conservative cancel culture”. She’s have been far better off not getting pissy about it, and then defending the revised law after she signed it. All that “conservative cancel culture” language did was give some ammo to left to use against us.

Have read the bill and her letter. The letter is unconvincing. She makes a couple of legitimate grammatical corrections, but then guts the bill as regards application to collegiate athletics and (altogether workable) enforcement mechanisms. It is an improper use of the style and form veto. She did it not because of advice from legal scholars — a smokescreen excuse — but because she was pressured, directly and through her staff, by the Chamber of Commerce and other business interests.
