I notice nobody has read the text of the letter or the bill itself. Schools would be getting sued from all over the place. A 5’4” 130 lb kid gets cut from the varsity team? Let’s sue the school, that’ll show them!

This is a lawyer’s dream.

Instead of her letter, where she is trying to deflect, read the bill. I don’t see anything that egregious, it sounds pretty straight forward. To complain that obtaining a written verification from athletes would be too burdensome for schools seems like a weak cop-out.

Have read the bill and her letter. The letter is unconvincing. She makes a couple of legitimate grammatical corrections, but then guts the bill as regards application to collegiate athletics and (altogether workable) enforcement mechanisms. It is an improper use of the style and form veto. She did it not because of advice from legal scholars — a smokescreen excuse — but because she was pressured, directly and through her staff, by the Chamber of Commerce and other business interests.

Speaking of lawyers, have you all even bothered to look at the legal team that she has advising her?

Read about Tony Venhuizen, her chief of staff, and Matt McCaulley, her top advisor. Both lawyers. Both with a dog in the fight.

Then get back to us about her unbiased analysis of the legislation.

Noem reportedly shut out supporters of the bill for weeks while she crafted a CYA surrender with corporate lobbyists and her staff. If that doesn’t show you which team she is playing for nothing will.
