Sidney Powell argues in new court filing that no reasonable people would believe her election fraud claims

Right-wing lawyer Sidney Powell is claiming in a new court filing that reasonable people wouldn't have believed as fact her assertions of fraud after the 2020 presidential election.

The election infrastructure company Dominion Voting Systems sued Powell for defamation after she pushed lawsuits and made appearances in conservative media on behalf of then-President Donald Trump to sow doubt about the 2020 election results. Dominion claims that Powell knew her election fraud accusations were false and hurtful to the company.

In a new court filing, Powell's attorneys write that she was sharing her "opinion" and that the public could reach "their own conclusions" about whether votes were changed by election machines.

"Given the highly charged and political context of the statements, it is clear that Powell was describing the facts on which she based the lawsuits she filed in support of President Trump," Powell's defense lawyers wrote in a court filing on Monday.

"Indeed, Plaintiffs themselves characterize the statements at issue as 'wild accusations' and 'outlandish claims.' They are repeatedly labelled 'inherently improbable' and even 'impossible.' Such characterizations of the allegedly defamatory statements further support Defendants' position that reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process."

Their use of language to spread bias is unbelievable.

Dominion is definitely involved in vote fraud regardless of whatever Powell has said.

The problem is, without a thorough investigation of the machines -- immediately the next day -- there's simply no hard proof. Statistical anomalies and conjecture isn't enough. Statements need to be backed up by hard proof. This is where Trump fell down.

It was obvious late in the evening where the problem counties were. Trump should have dispatched US Marshals Service and Treasury Department law enforcement officials to impound the machines at these sites for a thorough evaluation by qualified engineers and monitored by DOJ officials (although as corrupt as that group is, it's concerning how trustworthy they would be to honestly evaluate and make charges). Trump should have done this immediately -- before anything could be wiped or manipulated. He could have fought it out in court later should jurisdiction concerns be raised.

Unfortunately, this is now all moot. Machines were likely wiped and reprogrammed, and the current cabal will turn their backs to anything at this point anyway.

I still question Powell and Wood's credibility at this point. They might have had theories, but like the rest, without hard fast evidence, their positions seem more like unhinged rants than reality. I'm not saying there wasn't corruption with the voting machines (compounded by many other illegal vote schemes to add to the tally), but this bird has flown the coop.

It's too late.

So ignore the fact that Dominion machines has a rejection rate of 68% whan the FEC permitted rejection rate to be 0.0008%,( proven in Antrim Country MI) or that votes are counted fractuually rather than one man one vote? Or that the logs by law that are supposed to be kept, mysteriously got erased? Sorry but thats enough to prove fraud to a jury.

First off, I'm not an attorney. Perhaps those that are can comment more authoritatively.

That said, I would think that such a case of fraud would be very difficult to prove in lieu of actual hard evidence. Witnesses to the data erasing would need to come forward. Intent would need to be determined (difficult at best). You reference Atrim County, but that entire event still does not demonstrate that the machines physically switched anything except to the people in the room at the time. Again, those machines -- if suspect -- should have been immediately impounded by the Justice or Treasury Departments until evaluated. It sounds suspect, yes, but outside of election officials, who saw this occur? Could the test have been re-run in the presence of a formal board of inquiry. Unfortunately, they cannot, because the machines weren't impounded and tested immediately following the event. There's no telling what might have happened to them in the interim.

Worse, there's no one to chase this. The Michigan Attorney General has said she wouldn't. The Biden administration and DOJ won't. Even the Supreme Court has shown itself to be cowards in these matters. Even if attempted by local voters, the good old "standing" issue will eventually get it thrown out in this environment.

Was their fraud? Likely -- inside and outside of the machines. The problem is, it's too late. The time to have begun this process would have been with the impounding of the machines on Wednesday, November 4th.

An accusation is not defamation unless the accuser knows beforehand that the charge is false. It is demand for an open explanation; it’s how things work. Nobody knows but ‘minion.

Sidney was inside the line. ‘minions gesture amounts to little more than an obnoxious fart. Hope there’s a breeze that day.

The only problem with that is that a hand count in Michigan proved Dominion was punting perfectly fine ballots to adjudication. The rejection rate on the machines alone are in violation of FEC voting machine critera. As far as the Dept of Justice Or Treasury, they were in on it to get rid of Trump. You can’t convince Brutus to be an even better friend when he has knives out for you.
