Right-wing lawyer Sidney Powell is claiming in a new court filing that reasonable people wouldn't have believed as fact her assertions of fraud after the 2020 presidential election.
The election infrastructure company Dominion Voting Systems sued Powell for defamation after she pushed lawsuits and made appearances in conservative media on behalf of then-President Donald Trump to sow doubt about the 2020 election results. Dominion claims that Powell knew her election fraud accusations were false and hurtful to the company.
In a new court filing, Powell's attorneys write that she was sharing her "opinion" and that the public could reach "their own conclusions" about whether votes were changed by election machines.
"Given the highly charged and political context of the statements, it is clear that Powell was describing the facts on which she based the lawsuits she filed in support of President Trump," Powell's defense lawyers wrote in a court filing on Monday.
"Indeed, Plaintiffs themselves characterize the statements at issue as 'wild accusations' and 'outlandish claims.' They are repeatedly labelled 'inherently improbable' and even 'impossible.' Such characterizations of the allegedly defamatory statements further support Defendants' position that reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process."

This CNN bastardization of the story is completely at odds with the description I read elsewhere today. My understanding was that the question before the court was whether a reasonable person could ever, on their own, believe that the Dominion machines could have been manipulated, and that Dominion was arguing that no reasonable person could ever believe that (presumably to make the argument that only Sidney Powell’s magical powers of persuasion could ever make someone doubt the accuracy of voting machines). The CNN story is incomprehensible gibberish. It makes no sense.

Please read the fifth paragraph of the story. It is an elegant trap against the plaintiff.
Dominion is definitely involved in vote fraud regardless of whatever Powell has said. I feel sad for anyone who thinks otherwise.
For instance we know for a fact that Dominion machines rejected more than half the ballots in many democrat areas. And some un-monitored democrat got to just pick and choose how to vote those ballots. How could anyone believe that was not by design.
Anyone who stands up for Dominion or any of these electronic voting systems- Stands for vote fraud. Electronic voting should be outlawed. Anyone who does not think so is more than a fool. They lack even the most basic ability to reason. And this country will be done in by their stupidity.
Powell also claims in court that her statements about the 2020 election were a “matter of public concern” about a publicly known company, Dominion, and thus protected speech.
Her attorneys also claim she had a right to make accusations because she was acting as an attorney for the Trump campaign, even during her right-wing TV appearances. As a result, Powell is asking a judge in Washington, DC, to dismiss the case, or to allow it to be moved to the federal court in Texas.
It used to be truth was a virtue in Freeland. I actually believed that we were different as opposed to scanning a headline, believing fake news and being hoodwinked by propaganda let alone destroying our own no matter how imperfect he/she is (Powell and Wood)....Could team Trump have done better? Did it make it impossible that no remedy of our civil society and republic was of any help? America is dying with a whimper but we criticize the only voices besides Trump who vocalize anything outside of the echo chamber of our glorious website.

Powell’s analysis is well-founded in that courts allow large claims to be made in initial filings, relying on the judicial process to sort out their truth or falsity. Indeed, claims in lawsuits are traditionally treated as priviliged and exempt from scrutiny under libel laws.
