In an indictment unsealed today, a federal grand jury in Miami charged a Florida medical doctor and three others for their roles in an alleged scheme to falsify clinical trial data.
According to court documents, Dr. Martin Valdes, 64, of Coral Gables, Florida, Fidalgis Font, 53, of Miami, Julio Lopez, 54, of Miami, and Duniel Tejeda, 35, of Canon City, Colorado, were charged in a six-count indictment returned by a federal grand jury on Feb. 23, 2021. Each defendant was charged with conspiracy to commit mail and wire fraud and at least one substantive count of mail fraud. In addition, Valdes and Font were charged with money laundering and Valdes was further charged with making a false statement to inspectors with the U.S. Food and Drug Administration (FDA).
“The public must be able to rely on the accuracy and honesty of clinical trial data, which is essential to ensuring the safety of drugs approved for patient use,” said Acting Assistant Attorney General Brian M. Boynton of the Justice Department’s Civil Division. “The defendants undermined that process and put patients at risk. The Department of Justice will pursue and prosecute those who put personal profit before public health.”
According to the indictment, from at least February 2014 through at least July 2016, the defendants fabricated clinical trial data for profit while working at Tellus Clinical Research, a medical clinic based in Miami. The indictment alleges that the defendants knowingly enrolled subjects in clinical trials when those subjects failed to meet eligibility criteria, falsified subject laboratory results, falsified subject medical records, and falsely represented that subjects were taking the drugs being studied when in fact they were not. Valdes served as primary investigator for the clinical trials conducted at Tellus, Font was the owner of the business, and Lopez and Tejeda were senior Tellus employees.
“Reliable and accurate data from clinical trials is the cornerstone of FDA’s evaluation of a new drug,” said Catherine A. Hermsen, FDA Assistant Commissioner for Criminal Investigations. “Compromised clinical trial data could impact the agency’s decisions about the safety and effectiveness of the drug under review. We will continue to monitor, investigate and bring to justice those whose actions may subvert the FDA approval process and endanger the public health.”
“Falsifying clinical data is a violation of the public’s trust and it endangers the safety of consumers,” said Ariana Fajardo Orshan, U.S. Attorney for the Southern District of Florida. “Those who enrich themselves while compromising public health in this way commit serious crimes and will be prosecuted.”
If convicted of conspiracy to commit mail and wire fraud or mail fraud, each defendant faces a maximum penalty of 20 years’ imprisonment. If convicted of money laundering, Valdes faces a maximum penalty of 20 years’ imprisonment, and Font faces a maximum of 10 years’ imprisonment. If convicted of making a false statement to the FDA, Valdes faces a maximum of five years’ imprisonment. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.
Assistant Director Clint Narver, Trial Attorney Lauren M. Elfner, and Trial Attorney Joshua Rothman of the Justice Department’s Consumer Protection Branch are prosecuting the case. The FDA’s Office of Criminal Investigations, Miami Field Office, investigated the case, and the U.S. Attorney’s Office of the Southern District of Florida provided critical assistance.
Additional information about the Consumer Protection Branch and its enforcement efforts may be found at www.justice.gov/civil/consumer-protection-branch. For more information about the U.S. Attorney’s Office for the Southern District of Florida, visit https://www.justice.gov/usao-sdfl.
An indictment is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
Thanks, ‘note. Encouraging posts.
I know the CBP works hard. I didn’t think the CPB had any useful function and was just another layer of high paid bureaucrats.
They pretty much blew that when they set up trials designed to fail for HCQ + zinc.
But at least keep the little guys honest.
I worked as a coordinator in clinical trials for 10 years. Some crazy stories. One of my first trials, we were hooked up with an IRB (oversight group for sponsor and site) who was later caught in a sting operation by FDA. Wowsa. IIRC, the IRB was also headquartered in Colorado. What’s with Colorado?😀
So much for “believe the science.”
When can we expect to see the promoters of the phony anthropogenic global warming scare punished?
No mention what the drug or malady is??? Weird.
Frankly, I was wondering if it was you know...Covid-19 vaccines...
I’m bettin’ the phony drug is tequila.
Two drugs for Opioid dependency, two drugs for IBS, and one drug for diabetes. It’s in the download.
This is what to expect when there’s government money to be had.
There should be mandatory minimum 10 years in jail time for any government fraud including vote fraud.
If they gave a one-year amnesty, and a 10% reward for anybody who reported Government fraud, I bet we could cut the budget by 20% in one year. MINIMUM!
Lots of links to check. I read through several of them. NO MENTION of the drug or condition.
Why is everything so damned hush-hush nowadays?
Maybe just a coincidence. Maybe because the law is involved.
Before retiring I worked in clinical trials (the number crunching end of it). In everything we published, the drugs and medical conditions being studied were front and center. There was never any attempt to withhold information. What’s the point?
You are correct about HCQ + zinc. And who was part of the deceit? None other than the Gov of New York. Cuomo sabotaged the use of hydroxychloraquine when New York State received a large quantity and permission to run a trial early in the pandemic. He would only allow it to be given to people who were hospitalized, maybe even in the ICU, IIRC. No one had said that hydroxychloroquine +3 works at that stage. If given early in the disease progression, it seems to have a very positive effect.
The NIH structured the VA study on HCQ and they did the same thing. Gave it only after server damage was done and without zinc.
Luckily no Americans were involved.
The level of evil being done in this country, especially by and for the Democrats in power, is beyond anything that I could have imagined happening in the USA just a few years ago.
I had an oncologist who insisted I agree to participate in his clinical trial for which I did not qualify.
A person must be vigilant when studying clinical trials. The oncologist wants to enroll patients who will make their numbers look good.
My oncologist at MD Anderson discussed a certain approved drug for my type of cancer in which we suspect the drug company cooked the books.
I’m glad you figured out that your oncologist was trying to enroll you in a study for which you were not qualified.
My friend’s daughter and I accompanied her at the last minute to one such meeting and the Dr seemed shocked, nervous, and when her daughter (a nurse) asked if he was aware her mother had (insert medical term here) the Doctor suddenly “discovered” she was not qualified for the study. He had only planned on the patient showing up - one chair in his office, all others had been removed to the waiting room. It’s a scam.
Now we have these Covid-19 vaccine companies fighting over who has the best percentage in terms of results and I’m thinking their numbers are probably cooked because this was lucrative, world-wide contract for which they competed - money to be made off almost everyone, forever etc.
I just had a consult with that oncologist. He tried to schedule me for another appointment on three occasions. After the 3rd time, I contacted my urologist to tell him what was going on. His response was a very terse, “I’ll take care of it.”, and boy did he ever. He was not going to tolerate any interference with any of his patients.
When it was time to get an oncologist, I knew exactly who I wanted. My urology nurse and nurse practioner told me he was the guy they would tell their male friends to request.
This is why I am not going to get any of the COVID-19 vaccines. As more info comes out, they aren’t nearly as effective as advertised.
What I do know from my own investigation and person experience, the hydroxychloriquine cocktail works far better and in a much shorter period of time than any Vaccinnee.
The CDC claims that hydroxychloriquine cocktail must be administered in a hospital setting, yet hospitals refused to administered the drugs in a hospital setting
