In Alpine today, 26-year-old Devon Portillo admitted to lying to FBI agents during an investigation into the source of a racist text message purportedly sent by Portillo’s election opponent, announced U.S. Attorney Ashley C. Hoff and FBI Special Agent in Charge Luis Quesada, El Paso Division.
Appearing before U.S. Magistrate Judge David B. Fannin, Portillo pleaded guilty to one count of making a false statement to a federal agent. By pleading guilty, Portillo admitted that in June 2020, he was running for election against another candidate when FBI agents interviewed him about a racist social media text falsely attributed to his opponent. Portillo denied creating the racist text message. He later contacted the FBI and advised that the text was authored by another individual whom he identified to investigators. However, in a subsequent interview with FBI agents, Portillo admitted that he had indeed authored the fake text message and that the individual he identified as the author of the text had nothing to do with its creation.
Portillo faces up to five years in federal prison. He remains on bond pending sentencing. Sentencing has yet to be scheduled.
The FBI investigated this case. Assistant U.S. Attorney Mallory J. Rasmussen is prosecuting this case.

Well I agree, if you don’t talk you can’t lie. Plus many other reasons not to talk in general as FreedomPoster points out.
Thinking it over, I would guess it isn’t the text message itself they would be investigating but the potential crime of (in lay terms) intimidating a candidate for office. Just a guess.
Not only can you not lie, you cant be caught in a perjury trap. That’s how they got Scooter Libby and others. Just say that you have nothing to say.
All he did was make a racist joke. He should have never agreed to speak a word to F-troop about it. He would be a free man tonight.
When will people ever learn to not speak to the FBI, at all, ever, for any reason? Also if you are on a jury, do not convict, no matter the charge or the evidence if the FBI is involved in any way.
Putting them out of business in the courtroom in a widespread manner is the ONLY way to force reforms on them.

he posted something years ago. A racist joke that was a little funny, pretty immature, and used the N-word. An opponent found it and he claimed he must have been hacked.
No FBI jurisdiction unless HE called them to say he was hacked. No crime was committed until he told them he was hacked.
He should have shrugged and said he was an immature 16 year old, or even said nothing. Maybe you lose the race, so what?
But when the FBI knocked, it shoulda been no comment.

That’s good question. The text was a spoof against again an opponent in an election, but on the other hand, it was for a local county Sheriff election in Brewster County TX. Nothing to do with Fed.gov at all.

I watched it many years ago. The prof clearly spells out how an innocent person can get caught up as the primary suspect just by telling the truth.

Alpine? Talk about an out of the way place. I’ve been there. Look it up. I thought Monahans was sort of desolate, then you get to Ft Stockton, I thought whoagh! Then get on I-10 for a ways and get off going further south with nothing but rocks and sagebrush for quite a while. When I approached the T in the road where you turn right for Alpine or left for some God only knows what kind of place... There was an Elk standing there in the road. He ambled off hopped a fence and was soon gone. I’m not lying, I’m serious! I asked the locals about it and they said some wealthy guy had imported them there for some reason. I can’t help but wonder what they live off of.
