The (Vichy) Chicks File $6.6 Million Insurance Suit Over Canceled ‘Gaslighter’ Tour

The Chicks have filed a $6.6 million lawsuit against an insurance underwriter over its refusal to cover losses from the cancelation of the “Gaslighter” tour last year.

The band, formerly known as the Dixie Chicks, released their first studio album in 14 years last July. They also planned a 48-show North American tour, which was to kick off at the MGM Grand Garden Arena in Las Vegas.

The tour was canceled, along with every other concert tour, due to the COVID-19 pandemic. The Chicks’ touring company, Tunashoe Tours, had an insurance policy through Lloyd’s of London that provided up to $40.4 million in coverage in the event that the tour had to be canceled.

According to the complaint, 14 underwriters subscribed to the policy, but the suit only targets one of them: W/R/B Underwriting. The suit alleges that W/R/B has refused to acknowledge its obligation to pay, and has repeatedly asked whether the 2020 tour could be postponed to 2021.

The complaint argues that would be impossible. For one thing, the album has already been released.

“As of the filing of this complaint, it appears highly unlikely that the spread of SARS-CoV-2 will sufficiently subside and herd immunity will be established to allow concerts and other live events to resume in 2021,” the complaint adds. “Estimates of when this will occur are further complicated by variants of the virus that are already spreading in the United States.”

The suit states that W/R/B had urged The Chicks to drop Live Nation and find another promoter, or perform live-streamed concerts instead of live shows. The suit alleges that W/R/B’s suggestions were impractical, would have constituted a breach of Live Nation’s agreement, and were designed merely to mitigate W/R/B’s losses on the policy.

Of the 14 underwriters, the suit states that only W/R/B has taken this position. The suit was filed in Los Angeles Superior Court.

It seems to me that the Dixie Chicks may have been trying to make bank off of the current Covid situation.

In July of 2020 it was quite clear that large concert halls were going to be closed well into 2021 if not 2022.

The chicks are the ones canceling their tour and the insurance underwriter is right to dispute the claim.

If a band insures a venue/date for a concert and THEN there are closures that one thing (beyond their control). The band took out insurance knowing that venues were closed. It seems fraudulent to me. The Producers II.

I like old Dixie Chicks stuff but how is it better to drop Dixie and refer to themselves as The Chicks? Seems misogynistic to me. I guess it’s better to be misogynistic than racist these days.....

Release and promotion

"The album was announced on March 4, 2020, with a scheduled release date of May 1. On April 21, the release was postponed due to the COVID-19 pandemic. On June 11, the album's release was rescheduled for July 17."

So they had the album done just before shutdown. They went ahead and released the lead single March 4 (it bombed), and then later kicked the album release down the road when it wasn't clear what would happen after the shutdown ended.

There is no way a tour - even these biotches - is planned after a release of a lead single from an established C&W BroHo band. It just doesn't happen that way. They're with LiveNation -- LN takes care of much of the arena planning, probably just after the holidays when the first cases were breaking out near Seattle: "Hey Tunashoe, here are these dates here, here, and here. Release your single, release the album, and get on the road."

LiveNation was the one who called the hold on tours:

" Live Nation will re-evaluate the situation at the beginning of April (2020) with the goal of resuming touring in May or June.

Tours affected include Billie Eilish, Jason Aldean, Zac Brown Band, Cher, Kiss, Post Malone, Tool, Lynyrd Skynyrd, Chris Stapleton and many others."

The only payor who has defaulted is WRB.
