But business (and your employer) can.
I’d like to see it more like the Civil Rights Act — neither government nor business can discriminate on the basis of race. I’d like to see Free Speech like that.
I think we should be allowed to say whatever we want without being silenced. And bring back dueling. If I offend you, feel free to slap me with a glove and challenge me.

That’s the general rule. So now the right has to take a play from the left’s playbook and S Ct decisions. I am going from memory on this. Recall years ago Bob Jones University did not permit interracial dating among students. Students knew this and freely decided whether to attend this religious based university. The university did not receive any direct federal funding. However, some students were able to pay the tuition via getting their own federally funded or guaranteed student loans. Because federal money was used by the students, even though the school was completely uninvolved in the funding decision and transactions. Therefore, BJU could not prohibit interracial dating as federal COnsitution and civil rights statute applies to them, despite their religious beliefs.
Businesses all are regulated by the federal government, as a minimum by tax laws. Therefore, there is always a link. Not sure to what specific employer-employee concern you are pointing, perhaps it is a person who attended a political rally on his own free time, not wearing any company logo, etc ... and gets fired for merely attending the rally. Some states have “at will” employment, in other words, IOW, as long as the employer does not fire in violation of civil rights protections, the employee is s### out of luck. Listen to Charlie Daniel’s song “In America” from about 40 years ago. It talks about a very different country.
The frogs in the pot are now taking notice how hot the water has become, and it may be time to start jumping out. The frogs also believed the elected and judiciary would protect their liberties, that the school system would “educate” their children. I have run into more and more people that believe what they are told without thinking about what they have been told.
