Ohio can’t keep refusing to allow people to change the gender listings on their birth certificates, a federal court ruled Wednesday.
In response to a lawsuit brought by four transgender people, the U.S. District Court for the Southern District of Ohio found Ohio’s birth certificate rule imposed by the state Department of Health and the Office of Vital Statistics is unconstitutional.
The state was weighing an appeal.
Judge Michael Watson rejected the state of Ohio’s arguments that the policy helped prevent fraud and maintain a historically accurate record of its citizenry. He called such justifications “nothing more than thinly veiled post-hoc rationales to deflect from the discriminatory impact of the policy.”
The court sided with the American Civil Liberties Union, the ACLU of Ohio and Lambda Legal, which argued on behalf of plaintiffs that the state’s requirement prevents transgender people from obtaining a document essential to everyday living and subjects them to discrimination and potential violence. …

Nothing in the article said anything about why it was ruled unconstitutional. I'm not asking for a full disertation - just a finger pointing at the article and section or amendment which makes it unconstitutional. Since the tenth amendment says "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." and the power to register births is not delegated to the United States nor prohibited to the states, it looks like the state has full power on this.
Just ignore the judge.

This is so silly.
My take... let them put whatever they want on the birth certificates for the newly redefined word “gender,” but also put the sexual chromosome makeup on the certificate... XX, XY, or the occasional XYY and XXY. And that shouldn’t be changed.
When does shooting start?
With that kind of logic the judge may as well rule that God will not send Sodomites nor blasphemers to hell for all eternity, while he is at it!
Okay, just add some checkboxes for what “physiological equipment” they’re born with.
A birth certificate is a report detailing certain things that were facts at birth. If the birth certificate says one is born a male, that is a permanent situation, time-locked facts.
If the person later transitions to be female and wants to amend their birth certificate, the certificate becomes a fraud, no longer representing a fact regarding their birth. If the person wants to amend their birth certificate to say female, well if they were born female, there would be no need to transition.
Maybe I am a 45 year old trapped in a 60 year old body. I wish to alter my birth cert to change my birth year. Does that make it so?

Lawmakers on Tuesday adopted the 9th amendment to Hungary’s constitution, stipulating that a mother is a woman and a father a man. The government-sponsored amendment passed with 134 votes in favour, 45 against and there were five abstentions.
The fundamental law now protects a child’s right to identify with their gender at birth and an upbringing based on Hungary’s constitutional identity and Christian culture.
The explanatory text states that western ideology is changing in a way that necessitates guaranteeing the child’s right to self-identity in line with their gender at birth in order to protect the child from mental or biological intervention affecting their physical and mental wellbeing.

Hungarian nationality law is based on the principles of jus sanguinis. Hungarian citizenship can be acquired by descent from a Hungarian parent, or by naturalisation. Hey that's me! Looks like I better brush up on my Magyar nyelv, the way America is going it looks like Hungary is more like the America I grew up in and the democrats are destroying.
There is a solution to this. At birth take a DNA swab of each child and encode that onto the Permanent Record of Birth (PRB). Certificates are available in what ever flavor you want with or without the DNA info. Pay your money take your choice, you can be whatever little pronoun you want to dream up.
However, the PRB is the official state record and can never be changed. It contains clinical info DNA map that may be critical to the individual in later life for health and other legal issues. Think of the positive potentials and the negative. There’s your science. Forgot who you are or your a little bit confused? Go get a copy of you PRB, you can still play with your personal pronouns ‘til the cows come home.

Birth Certificate
Driver’s License
multiple other pieces of ID....
BUT the sex doesn’t match on all the ID presented......
So. Falsification of official records, not just personal choices about how to live.
GENDER: They haven’t make up their mind.
That’s still pandering to them.
Anyone have any delusions that the Supreme Court will right this horrid decision?
