Sidney Powell Reveals She's Been Building a Massive RICO Case Against Dominion, Smartmatic
The Western Journal ^ | 13 Dec, 2020 | Jack Davis

Posted on 12/15/2020 5:36:02 AM PST by MtnClimber

Attorney Sidney Powell says that her battle over the Nov. 3 election is far from over, saying that the evidence she is gathering could turn into a major racketeering case under the Racketeer Influenced and Corrupt Organizations Act.

Powell appeared Thursday on Lou Dobbs’ Fox Business News program and explained what she has found.

Four names, she said, were central to her investigation: Jorge Rodriguez, a former minister for communications for Venezuela; Khalil Majid Mazzoub, whom Powell identified as a link to the U.S.-designated terrorist group Hezbollah; Gustavo Reyes-Zumeta, a computer programmer; and Antonio Mugica, CEO of the elections technology company Smartmatic, which has been linked in some accounts to Dominion Voting Systems.

I’d like to, but here is the deal:

1 Timothy 5:19 ESV / 12
Do not admit a charge against an elder except on the evidence of two or three witnesses.

Deuteronomy 17:6 ESV / 9
On the evidence of two witnesses or of three witnesses the one who is to die shall be put to death; a person shall not be put to death on the evidence of one witness.

Numbers 35:30 ESV / 14
“If anyone kills a person, the murderer shall be put to death on the evidence of witnesses. But no person shall be put to death on the testimony of one witness.

Etc

I’m taking the high road here. I need at least one other witness to take his claim seriously. I really want to, but I know better. I don’t know him personally. We need another witness, but so far there are none forthcoming.

And another thing. “Troll” doesn’t mean “someone that disagrees with you”. Frankly, calling someone a troll is as repugnant as calling someone a ni**er. It’s pure ad-hominem, and insulting.

I admire your inability to see the truth.
It’s quite breathtaking.

People like you make this site, and conservatives in general, look bad.
Sidney is Lucy, and you’re Charlie.

See my post just above this one.

I’ll add, calling people trolls simply because they disagree with your really damages your credibility.

Any use of ad-hominem does, frankly.

She can’t. She’s a private lawyer and has no authority to “build a case.” She could collect evidence and turn it over to someone but considering all the “evidence” she’s presented in court has been Laughed at I doubt it.

It’s like arguing with leftists. raw ad-hominem

And it really is looking more and more like the Lucy/Charlie analogy does fit.

Looks like Barr was Lucy too, frankly.

What nay nay childishness are you talking about, BTW?

Your argument style is more like a leftist than a conservative. I’ve been arguing with leftists on political forums since 2006. I’ve been here since 1997.

But I know that claims, even from the conservative side, need believable evidence to float. I learned that back in the beginning where I posted stories (like the army raid of the CIA) on these leftist sites and the smart ones utterly burned me. And I deserved it.

I’m starting to wonder if a lot of conservatives that are Q followers are having a hard time dealing with what is going on right now. We’ve been let down by a lot of people. Sessions, Barr, and now, apparently Sidney (but that has not fully played out). I stood behind Barr until his time ran out - the election. I’m going to be a little more careful about that in the future. The swamp is real.

Just so you know, RICO can be enforced by civil lawsuit. I filed 43 in 1984 for the first ones in the Western District of Oklahoma. Treble (triple) damages and attorney fees are statutory. Read the law before making judgments.

I hope you both have very good days, and think to correct your accidental misinfo.

You are trying so hard to paint Sidney Powell as a failure. Your troll butty is trying to convince folks that she is working her ass off to write a book. Get your smarmy ass out of bed early this coming Saturday. There will be much to take in, little troll boi.

Time to start delivering.

Past time, actually.

Hey, I am just a simple retired soldier. I am not a lawyer. That is why I rely on folks like you. Thanks for the education this morning.

No, Ms. Powell would not have to prove personal harm. She would have to prove harm to her client.

In addition, The RICO as I believe she referring to is the Federal statute, which has a criminal element and a civil element. The only way that the State location matters for anything is determining the federal court jurisdiction location for the lawsuit. Likely Prez Trump's legal residency in FL would put such a civil suit there? Or if she would pursue this in her individual capacity it would be in Texas?

You are trying so hard to paint Sidney Powell as a failure.

Actually, no. I’m saying that like Barr, Sessions, and so many others, she’s not delivering. That Kraken thing was really a failure, though. When you promise the moon and only deliver a rock, well, your reputation is damaged. That’s just how it works - with everybody except your mom.

I don’t know what you mean about book writing, etc. I hope she comes through with everything she says she will, but I’ve not seen anything yet. I hope she proves me wrong.

But the troll nonsense is just silly. You really need to look that word up.

I have to add this one thing: The types of responses I’m getting from some on this site, e.g. you, are the type of stuff I deal with handily on leftist sites for over 15 years. I really don’t like dealing with it here. I see this as a more adult site.

Hi mosaicwolf,

I hope you are well. I don’t begrudge anyone that hasn’t gone to law school. The most informed and intelligent people never went. Sometimes I think it is a curse that I carry with me much like the Scarlet Letter in Hawthorne’s book. I would dare say most (that is 50% +1) lawyers are not familiar with civil RICO. I would think it is closer to 80% of lawyers that do not know off the top of their heads.

Interesting thing about civil, or criminal RICO is that it only requires two prohibited acts. They are listed in the statute. Wire fraud, securities fraud, and mail fraud are in the list. Then there is a catch all of what is referred to as “garden variety” fraud. There is a requirement for two independent acts. There is no statute of limitation.

Thanks for your kindness.

I’d share a foxhole with you any day; but I hope it doesn’t get to that.

Gwjack

RICO has provisions permitting a private party to file a civil claim based on damage to their business or property by a racketeer, if they can prove a RICO predicate offense (one of a laundry list of offenses defined in Section 1961 of the Act).
