"Just so you know, RICO can be enforced by civil lawsuit. I filed 43 in 1984 for the first ones in the Western District of Oklahoma. Treble (triple) damages and attorney fees are statutory. Read the law before making judgments."

Hey, I am just a simple retired soldier. I am not a lawyer. That is why I rely on folks like you. Thanks for the education this morning.

Hi mosaicwolf,

I hope you are well. I don’t begrudge anyone that hasn’t gone to law school. The most informed and intelligent people never went. Sometimes I think it is a curse that I carry with me much like the Scarlet Letter in Hawthorne’s book. I would dare say most (that is 50% +1) lawyers are not familiar with civil RICO. I would think it is closer to 80% of lawyers that do not know off the top of their heads.

Interesting thing about civil, or criminal RICO is that it only requires two prohibited acts. They are listed in the statute. Wire fraud, securities fraud, and mail fraud are in the list. Then there is a catch all of what is referred to as “garden variety” fraud. There is a requirement for two independent acts. There is no statute of limitation.

Thanks for your kindness.

I’d share a foxhole with you any day; but I hope it doesn’t get to that.

Gwjack
