To: Til I am the last man standing

I find it difficult to believe that the Supreme court justices would be dumb and naive enough to allow their debate to be overhead like that. They always keep a tight lip until the ruling comes down. Many people have thought they would rule one way based on asked questions only to have them rule totally opposite.

However, I will say that none of Trump’s 3 justices have impressed me at all. Any high hopes I had of Amy Barrett came crashing down. She will be a disappointment for liberty like the other two.

If the argument was uncharacteristicly loud, things could have been heard by people out in the hall. Barrett is in a tricky spot because she was confirmed right before the election. She comes across a a "goody-two shoes" type girl, whom Roberts could intimidate. She literally doesn't have a pair.

I said at the time of her nomination that the BEST case scenario we could get was an equally divided 3-3-3 court (3 solid conservatives, 3 squishy "Republican" judges who can defect to the dark side on any given case, and 3 hardcore marxists)

FReepers thought I was being WAY too pessmistic with that one. Numerous FReepers accepted the "fact" that Trump had "cemented a conservative majority for decades", and while they sneered about how Bush betrayed us with Roberts, they were convinced Trump's judges were all pure as driven snow, and went around sighing "God Bless PDJT for keeping his campaign pledge to give us pro-life Scalia-like judges!!!"

Of course I noted at the time that Gorsuch had already voted to the LEFT of Roberts on at least three cases, Kavanaugh had gone on record saying Roe v. Wad was super-duper "settled law" and had shown little evidence he was any sort of improvement over Anthony Kennedy (the squish he succeeded), and the jury was still out on ACB although she APPEARED to be an actual sincere conservative in her personal life, UNLIKE Trump's first two SCOTUS picks)

I gave about a 5% chance that ACB would turn out to be a dud. Based on her first major action on the court being a HUGE failure, I'd take those odds up to about 20% now (which is ironically more optimistic that most of you are feeling about ACB right now). If she DOES turn out to be an otherwise 100% across-the-board solid conservative for the rest of her tenure, we can chalk up her first action on the court as simply being total cowardice. If they ever do a "Profiles in Cowardice" book, she could be Chapter 1.
