55-year sentence affirmed for 15-year-old MS-13 gang killer

An appeals court affirmed a 55-year prison term Tuesday for a member of the MS-13 gang who organized the killings of four teenagers in a Long Island park when he was 15 — but it also expressed regret that the end of parole for federal prisoners means he won’t have incentive to reform.

A panel of the 2nd U.S. Circuit Court of Appeals ruled that the prosecution of Josue Portillo, now 19, is a “classic illustration of the unfortunate consequences” of a decision by Congress that eliminated parole for federal prisoners sentenced in or after 1987.

The ruling, written by Judge Jon O. Newman, said the intent of Congress to end disparities in sentences and to send a message to the public that prisoners will serve nearly all of their sentences was not achieved, in part because the public gets a muddled message since most state courts still offer parole.

The 2nd Circuit said parole might motivate Portillo to obey prison rules, obtain education, participate in rehabilitative programs and mature to a point where he could rejoin society.

Judge cares about this guy rejoining society after killing four people. Good grief how did we get to a place where a bleeding-heart cares about an MS-13 gang member that killed four people more than he does for the safety of honest law abiding citizens of America.

Who cares if he reforms or not.

Shoulda been executed. But 55 YEARS is ok...he will be 74...what a complete waste. My compassion meter hasn’t moved.

So tax payers will fork out $1,705,000.00 ($31k/yr) to drastically extent the life expectancy of this piece of filth when less than a dollars worth of electricity would resolve the problem.

He can call for a minister to share the Gospel with him. He must NEVER, EVER rejoin society.

Even if you left him out on the street odds are some other gangbanger would take him out. MS-13 members aren't known for their long life expectancies.

We have the liberal Supremes to thank for outlawing executions of under-18 murderers. Not Diana Ross’s Supremes. The ones in black robes.
