It doesn’t matter who seized the servers, it matters if they monitored and recorded the data being transmitted.

If the bad guys took the servers, that adds to crime/cover up and I’m sure that was monitored as well.

Better to let the bad guys seize the servers so the good guys can seize the bad guys with the servers.

The bad guys ALREADY were operating the servers in Germany. They could have cleaned out the software on morning of Nov 4th.
