While we're being distracted by broken windows, the foundations of our government are being plotted against. As comfortable as this professor is discussing the neutering of SCOTUS, I'm sure it's not an original idea.

And now we know.

Samuel Moyn is a moron spouting every fantasy scenario the progs are dreaming up.

Most of that crap will result is total chaos which will open the door for the President to invoke the Insurrection Act.

I am going to dumb down the Supreme Court nominating process. The party in control is going to nominate someone they feel will support what they believe in. From far left to far right. It’s why being president counts. No doubt Biden would go with an opposite pick. It’s not rocket science.

how the left should think about the Supreme Court and how to disempower it.

It would be funny if it weren't so tragic. For decades the Supreme Court has made rulings to favor the left that they could never get through legislatively. For example, even California residents had voted that marriage should be between one man and one woman, but the court decided that perversion is OK.

And if you want to get to the root of it....

Libs just cannot abide or handle being told NO.

We have to handle it when they win.

But they dont when we win. Look at the results.

Progressives have always seen the Supreme Court as a center of government power, as useful in being able to change the rules to the way they want them.

This concept is over 100 years old in the United States.

Stalinists lie. Always

If this law professor cannot abide by the law (and seek to change the game just because his side is now losing), he shouldn’t be training our next generation of lawyers, judges, and politicians.

As a side note to this thread, please consider the following.

"Video interview of Yale Law Professor of Jurisprudence Samuel Moyn on how the left should think about the Supreme Court and how to disempower it."

Similarly to answering what year the War of 1812 was fought, the answer to how to disempower the corrupt, post-17th Amendment ratification Supreme Court is likewise clear.

Wake up the sleeping, unconstitutional federal funding-begging state legislatures to repeal the 16th and ill-conceived 17th Amendments.

"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." —Justice John Marshall, Gibbons v. Ogden, 1824.

In fact, once unconstitutional federal taxes are permanently stopped, taxes that corrupt Congress cannot justify under its constitutional Article I, Section 8-limited powers, the states will ultimately find a tsunami of new revenues that they can use for all sorts of things.

For starters, the states can improve public schools, including raising teacher’s salaries. The states will also be able to provide more funding for police and fire departments, raising the salaries of police and firefighters too. The states can also repair and expand infrastructure.

Send "Orange Man Bad" federal and state government desperate Democrats home in November!

Supporting PDJT with a new patriot Congress and state government leaders that will promise to fully support his already excellent work for MAGA and stopping SARS-CoV-2 will effectively give fast-working Trump a "third term" in office imo.

I don’t see any problem with voting Republican ticket for 2020 elections.

Insights welcome.

He also posits ways to disempower and control a conservative Supreme Court, such as 'modest packing' and then mandating a SCOTUS supermajority for every ruling

How does that work? Supreme Court rulings aren't a pass/no-pass thing, it's an "A or B" thing. Requiring a supermajority to make a ruling, only works if every ruling is a supermajority one way or the other. If one side barely loses, the other side barely wins. So would that count as a draw, with VP Pence picking the winner?
