Miranda was totally made up out of whole cloth. There is no obligation to warn a criminal defendant not to confess in the US Constitution. That was a policy decision from the SC in the mid-60s.
The Constitution says that a defendant can’t be forced to testify against himself. And, prior to Miranda, there was a long body of cases on confessions and whether they were voluntary or not. Police can’t force a confession out of a suspect, and they were not known for being scrupulous about ensuring that defendants were not coerced into a confession. But the Constitution didn’t require Miranda and its specific requirements.
