To: Harmless Teddy Bear
You might notice that it is raising an ethical and labor concern. In other words, very legally iffy.

Based on recent SCOTUS rulings I guess if an LGBTQ person refuses and you fire them it's gonna tie-up the entire Federal court system for the next thirteen years.

Probably.

But most states have made requiring employees to be non-smokers against the law. So it probably will never get to federal court.

I remember a few years ago Scotts tried this. They had to retreat after the state passed a new law saying "naughty, naughty, naughty".
