Austin Police identifies man killed in shooting during downtown protest Saturday

He summarized that witnesses told APD a vehicle began honking its horn as it turned south onto Congress Avenue from 4th Street. He said the vehicle stopped “as there were a large number of people in the roadway.”

Manley said that Foster, who was holding an AK47-type assault rifle, approached the driver side window of this car as others in the crowd began striking the car.

“Gunshots were fired from inside the vehicle at Mr. Foster,” Manley said. “During the initial investigation of this incident, it appears Mr. Foster may have pointed his rifle at the driver of this vehicle prior to being shot.”

Another individual told APD that after that first volley of gunfire and seeing the car drive away from the crowd, they drew their concealed handgun and fired multiple shots at the car. Manley said this individual was also brought to the homicide office to be interviewed, and this individual’s handgun, along with Foster’s rifle, were also taken into evidence.

Both the driver of the vehicle who fired at Foster and the individual who fired at the car later on have been released “pending further investigation,” Manley said. He also noted that both people have concealed handgun licenses.

Agreed. There is no equivalence in this case.

This was someone who attended with a gun to use it with aggressive and hostile intent, and was brandishing it, even pointing it at another person according to accounts.

I have no doubt the gun was loaded, and I would not be surprised if the safety was off. The rightfully dead idiot broke all rules of firearm safety, never mind acceptable and legal behavior as a citizen with rights.

Could you imagine even one person, a SINGLE person at a 2nd Amendment Rights rally doing such a thing? They would roundly be criticized and dressed down by every single person there, and likely would have been banned from participating or associating.

Of that I have no doubt, none at all.

I beg to differ. How many tens of thousands of protestors showed up at the capitol in Virginia, armed, to protest that legislature’s agenda to take their arms? Goes for the lefties as well as the righties.


The Virginia Capital Protestors were not breaking the law, they were not blocking traffic and they were not pointing their fire arms at other people. If this dude was working an illegal traffic stop or barricade with a loaded fire arm he was an armed combatant and the Virginia people were not.

Also, shooting at the car when not in jeopardy should be a criminal act. The driver acted in self-defense, the second person did not.

Pointed the gun and did not shoot....

How can the person in the car determine intent and future actions? Was he supposed to allow the attacker the first shot? Shoot first and ask questions later.

Only if you're a policeman and the individual fleeing has fired a laser at you. Though that rule only applies if you're a blm protester. If you or I did that we'd be facing felony charges, likely attempted murder.

Yeah, the mayor seems unconcerned that the streets were being blocked and drivers threatened. He’s heartbroken because his Antifa thug paid the price for pointing his gun at an innocent citizen.

Now, the “best” journolists are too busy bullying the President and his family.

In Texas it doesn’t matter whether such a driver/shooter has a carry permit. Drivers are permitted to carry loaded ready firearms in cars, and use them in self defense.

As described in this article this driver used his firearm in self defense. Conversely, the “protester” who fired at the driver should be at least charged with a manslaughter. The question of whether to elevate the manslaughter charge to 2nd degree or 1st degree murder would hinge on proving that the second shooter should have known, or knew, that the driver was defending himself.

You need to read more carefully. I simply pointed out the obvious, namely that whoever fired at the driver escaping from the mob was acting recklessly. There is no legal basis for shooting at a car which is driving away from such a situation (except perhaps by the police in some states) and given the crowd present whoever fired at the car was acting recklessly.

How am I being naive?
