U.S. Court of Appeals for the District of Columbia Circuit responded on Friday to a petition for rehearing en banc by halting a prior order for U.S. District Judge Emmet Sullivan to dismiss the Michael Flynn case.

ORDERED that, within 10 days of the date of this order, petitioner file a response to the petition for rehearing en banc. not to exceed 3,900 words. The government is invited to respond in its discretion within the same ten-day period. Any response from the government may not exceed 3,900 words. Absent an order of the court, a reply to the responses will not be accepted for filing. It is
FURTHER ORDERED that the effectiveness of this court’s order issued June 24, 2020, will be stayed pending disposition of the petition for rehearing en banc. See D.C. Cir. Rule 41(a)(3) (order granting writ becomes effective automatically 21 days after issuance in the absence of an order or other special direction of this court to the contrary).

This is beyond injustice, this is sedition. The judge refused an order. It is as though ALL cases must go to the Supreme Court to be complete.

Sullivan will take this to the Supreme Court if he can. The appeals panel should have removed him from the case.
Barr cannot order a dismissal.
Flynn plead guilty.
If we are following the law, it should have ended there.
I agree the judge is being a jerk. I agree this was a bad case from the outset.
But Flynn plead guilty. If he hadn’t done that we would have been done with this months ago.
I guess the moral of this story is don't plead guilty unless you really mean it, and are ready to take whatever punishment they give.

You are correct in this. From the ballot box to the bullet box is the path we must take. IMO, after the election is too late. I fear the fix is in already and the so called blue party, is as soft and fuzzy as a Jihadist.

These judges are either incredibly incompetent, seditionist losers or politically compromised such that they have no integrity. What an embarrassment to law-abiding, civil society. Pathetic.
