Judge hears dual petitions to recall Seattle mayor (Durkan)

The petition accuses the mayor of: “Malfeasance and violation of oath of office.” It also said Durkan, “Led a militant police force against citizens peacefully protesting,” when officers used tools like tear gas and flash bang grenades to disperse crowds.

Attorneys for the mayor called the allegations “legally insufficient,” and pointed to what they called a lack of any evidence, which “fails to provide any applicable rule, law or standard that was violated.”

“We respectfully request the court to dismiss this petition,” said Ryan Groshong, the attorney for the mayor.

The other petition that was filed had further accusations and alleged that the mayor “endangered the peace and safety of the community” by issuing a curfew without giving people enough time to disperse safely. It also accused the mayor of failing to protect freedom of speech and assembly, among other accusations.

“This is exactly the kind of case that recall is prepared for,” said Elliot Harvey, who spoke for a group who filed the second recall petition.

After hearing the cases, Judge Roberts will have to decide if there is enough evidence of wrongdoing on the mayor’s part for those the petitions to go forward.

Why does the judge get to decide if the alleged malfeasance is sufficient to validate the petitions?

That means that if a judge is party-loyal to the mayor, no recall is ever possible.

Please define "peacefully protesting". Be specific. OH! You mean AFTER the burning buildings when the peaceful protestors were all holding hands singing Kumbaya

It all sounds pretty amateurish and juvenile. I'm pretty sure there are better, more serious charges that could be filed against her.

Like allowing 6 blocks of the city to be taken over including a police precinct while innocent citizens lives and businesses were jeopardized, put in harms way.

There are no Obama judges or Bush judges or Clinton judges etc.

Nothing will happen. Most citizens of Seattle condone the Mayor’s actions and would elect her again if given the chance. Beating a dead horse on this one. Do something constructive, Boycott CNN.

Where are the petitions to have her removed for her repeated failures to act against the CHOP occupiers before their reign of terror led to deaths???

All the petitions against her seem to be of a mind that she was not progressive enough.

The recall provisions in the Washington State Constitution and the court cases are such that there is no amount of malfeasance or misfeasance that the State Supreme Court would approve if the elected official is a Democrat or a liberal.

The law states that all doubts are to be in favor of the petitioner. In reality, all doubts go to the benefit of the office holder if the person is a Democrat or part of the Washington Deep State.

The Constitution need to eliminate the requirement that the courts determine if an elected official has violated their oath of office. Just allow people to petition for removal and then put it to a vote.
