Flynn & the U.S. v. Sullivan (AKA In Re: Michael T. Flynn) is going to be streamed from the DC Circuit Court of Appeals tomorrow (Friday) at 9:30 AM EST.

Because the DOJ filed the motion to dismiss, so Powell withdrew Flynn’s motion to dismiss and adopted the arguments of the DOJ.
In essence, the DOJ then became the lead party in the Petition for the Writ of Mandamus. When the DOJ, after filing a amicus brief at the invitation of the COA, Sullivan then had to respond to both the U.S. Goverment and Sidney Powell. Having the DOJ as the lead party in this action increases the odds that it will be granted, so much so that the result is a slam dunk.
Powell was allowed to submit the appellant brief and also a reply brief after Sullivan submitted his answer.

How is any court supposed to do its work properly if political hacks turn it into a pay per view style circus?
Former Fed Prosecutor Joseph diGenova and his wife were recently talking about this case and it’s looking good for Flynn.
Joseph thinks the circuit court has decided to dismiss. All sides only have 15 minutes (!) to state their arguments (amicus folks get no time to speak). Add to the fact the superior court only gave ten days for Sullivan to respond and it could be construed that they’re not happy with the judge.
Flynn should sue...the DOJ’s dismissal brief reads like an indictment.

I believe that the Asst. Solicitor General will be arguing for the DOJ.
This is US vs. Sullivan because the hearing is about the duties of Judge Sullivan based on the “petition for writ of mandamus” of Flynn’s attorney asking that the DC Court of Appeals to issue an order to Sullivan to dismiss the Flynn case.
So this is the hearing in the appeals court, with a short oral presentation from each of Flynn’s counsel, government (DOJ) counsel, and Sullivan’s counsel.
I do not want to be disappointed.
CONCLUSIONFor these reasons, Petitioner respectfully requests a Writ of Mandamus ordering the district court to (1) grant the Government's Motion to Dismiss with prejudice, (2) vacate its order appointing an amicus curiae, and (3) assign the case to another judge for any additional proceedings.
By it's ORDER of 4 Jun 2020, the D.C.Circuit court set oral arguments to start 12 Jun 2020 at 9:30 a.m; one counsel per side to argue.
Sydney Powell will argue for Petitioner Michael T. Flynn.
