Flynn & the U.S. v. Sullivan (AKA In Re: Michael T. Flynn) is going to be streamed from the DC Circuit Court of Appeals tomorrow (Friday) at 9:30 AM EST.
The court is expecting a lot of interest in the case, so they’re directing people to their YouTube channel, which is here:

Beth was awful. Not that it means anything. Wilkins was obvious kept pulling white cop and black victim out of his hat.
Is that grounds for appeal?
Reo is on our side, Wilkins is a far left political judge, he’ll always throw the law out for politics. Henderson, a Reagan appointee and Bush appointee will be the swing vote, and didn’t sound particularly supportive.

From listening to the Judges’ comments, I’d say they will send the case back to Judge Sullivan so he can hold his “hearing”, which then allows him to either dismiss or not. Appeal Court Judges said, “if he does not dismiss at that point, come back and see us then. But Mandamus is not warranted.” At least, that’s my takeaway. I’m not an attorney but was raised by a damn good one!

That was my takeaway also...but you never know for sure solely from oral arguments/questions. I’m also not an attorney. Tried to stay in a Holiday Inn Express recently but it was closed due to the Coronavirus.
Flynn must be exonerated in a Court of law so that he can participate in government again, protect himself with firearms again, and maybe go after the Obama Coupsters in a Civil case.
Good summary and why I think this kabuki theater will continue as long as “ protectionism” of those who perpetrated this sham can be protected.
Who knows maybe they are waiting to see if Barr/Durham “ prosecute” anyone close to the origins of this..

If the public had a clue what hacks these judges are, there would be a stronger outcry that we get now. We're pretty much a banana republic, and the judges are a big part of that.
There is no ddeadline. Pretty much up to the judges. They could wait and see what Sullivan does then issue a "case is moot" ruling six weeks from now.
I've been deeply bothered that the DOJ chose to withdraw the case on the grounds that there was no investigation, not on the grounds that the case was manufactured to destroy Flynn and hopefully to get some dirt on Trump. It gives Judge Sullivan wiggle room to ignore the Brady violations, the new material and the fact that Flynn was both coerced into pleading guilty and was lied to by his own attorneys who out of self-interest convinced him to tell his only lie: that he told a lie to the FBI.
The case is a Byzantine mess whose purpose is to confuse folks who get lost in the complexity of lies. Even I was upset at Flynn when he admitted guilt and had appeared on Russia TV as a commentator. His book “Field of Fight” contradicts the concocted narrative that he is not the Boy Scout which I believe he is. Since then I read most of the Court briefs, and the evidence, and puzzled over the Stroke/Page texts with everyone else. My conclusion: America needs to sit down and study the Constitution and choose whether we want to have a triparte system or not!

Wait and see what Sullivan does? Does that mean Sullivan can convene a jury to hear his version of the case, and require Flynn to appear ?

No, it doesn't mean that. It means wait until after the July District court hearing and subsequent ruling (which has no deadline either).
The courts don't care about Flynn, he's not incarcerated so as far as the courts are concerned, no harm is occuring, period. Trial judges are getting a new power!
Everybody wants to rule the world, especially judges.
If Sullivan enters an order as nutty as the one you suggest (which I admit would not be nutty for Sullivan), Flynn can file another petitition for mandamus, this one around whatever orders create the trial.

You know, I am part of the public, millions of us, who support General Flynn. I know how depraved the swamp is, knew it before Trump did in his first months of office—before Flynn who didn’t know that the terrorists he negotiated with in Afghanistan were more honorable than Pete Stroke and Andy McCabe.
Since following this case, their method has become crystal clear, e.g., Judge out of the blue in Flynn Appeal talks about DOJ abuse by white police of a black victim. ValJar and Lawfare send out the script, it gets repeated by all the Coupsters, becomes the international headline du jour, and only President Trump in his Twitter feed punches back loud enough to be “heard”.
Can this Republic be saved? As long as we have Generals like Trump and Flynn it’s worth the fight!
