Sidney Powell said yesterday she expected Judge Sullivans ruling today

what is the hold up?

The delay is due to the time that is needed to coordinate spin stories at CNN, NYT, and WA Post. The Judge when he releases the ruling will be assured that the “proper” media already has Democratic Party talking points in hand.

There is quite a bit wrapped up in this case. It’s not just dealing with Flynn’s plea.

The judge has been confronted with a filing from the government that reflects malfeasance by Team Mueller lawyers, possible failure to represent by Covington.

That’s just utterly ridiculous. Sullivan is gearing up to hammer the former prosecutors. I doubt very much he will do anything but accept this outcome for Flynn.

Judge Emmette Sullivan is a comrade of the Kenyan, he’s a lib democRAT. Over the weekend Obama ranted and raved about “justice” which he (Obama) has a one sided view. The guess here is that somehow Sullivan will balk as much as he can against the DOJ. Wouldn’t be surprised if he calls for a special prosecutor as the lame stream media will go along. He’ll go down swinging. After all, he already called Flynn a traitor.

Seriously though. Lower your expectations in regards to justice in this matter and you'll never be disappointed.

While Democrats rally the troops and attack at a mere whisper, Republicans never seize an opportunity to strike and take out an enemy.

We can only hope The Great Pumpkin comes next Halloween.

This is the same judge that slammed the DOJ in the Ted Stevens case for withholding exculpatory evidence that. Although he ruled against Flynn early on some Brady disclosure, obviously he wasn’t provided the complete picture by DOJ prosecutors.

He could blow his top

I don't see how he has a choice here. The FBI flat out admitted to malicious prosecution here. Flynn is a 3-star General and has been obviously wronged by a corrupt defense team and criminal prosecutors. I would think he has to demand a full investigation.

that’s 100% correct IF this is a decent judge, which remains to be seen ... Brady violations and wasting the court’s time is the two biggest sins a prosecutor can commit (except maybe fabricating “evidence”)

According to Judge Nap this morning, Sullivan has 3 options.

One is to dismiss with prejudice, which would preclude any further prosecution of Flynn.

Second would be to accept the plea and sentence Flynn, which would be immediately overturned upon appeal.

And the third, and most likely, he can dismiss and strip the immunity of the government to be liable for suit. This would allow Flynn to sue the government to recover his legal expenses.

While I’m not a big fan of Nap’s legal crystal ball, with this particular judge, I’d bet on option 3.

I believe the coupists are claiming there were no Brady violations. I haven’t followed it too close, though. Could be wrong.

My guess is judge will toss the case back to DOJ and won’t take any position on the alleged Brady violations and prosecutor misconduct.
