Jones was pulled over Monday night in Travis County for speeding 45 mph in a 40-mph zone.
This in and of itself tells me he was targeted. Likely he was pulled over for GOING TOO SLOW. Impeding the flow of traffic.

IIRC, if you are between .03 (?) and .07, you still get charged with DUI.

That isn’t the criteria. If you are driving erratically and you had any alcohol in your system you can still be charged with driving under the influence
The .08 is presumptive.... by state law that limit and above me and you driving while impaired no matter how you were driving
