Father Surprised To Learn He Can't Gain Access to 12-year-old Daughter's Medical Records Without Her Permission

An Iowa father was surprised to learn that he no longer has access to his daughter's medical records, prompting a local television station to investigate.

In a report from KCRG-TV, Kevin Christians says he received a letter from the University of Iowa Hospitals and Clinics that informed him once his daughter turned 12, Christians would not be allowed to view her medical records without her consent.

"We believe that children at this age should take a more active role in their own health care and have a choice to keep some information private," the letter says.

Though the letter offers no explanation for the change in access, the letter is tied to a federal law enacted in 2002, an offshoot of the Health Insurance Portability and Accountability Act (HIPAA) enacted by Congress in 1996.

The HIPAA Privacy Rule is geared towards the protection and privacy of individuals, including minors, regarding health care. Under the law, parents have full access to their child's medical records "as his or her minor child's personal representative when such access is not inconsistent with State or other law," the U.S. Department of Health and Human Services says.

State laws are inconsistent in regard to the age where children must consent to give their parents access to medical records. Many states, such as Iowa, have no set age and require individual hospitals and clinics to determine consent age.

"I think there should be dialogue, and I think in this case they are limiting that dialogue that I can have as a parent with my child," Christians said.

Educate yourself and look up Dr. Childress. Then again that might keep you from continuing to cash in on the pro-BM governmental divorce attorney.

He had them EVERY weekend and she was a “daddy’s girl” before his ex-shrew and his equally enmeshed battleaxe ex-MIL poisoned them.
She managed to finish them off in less than five years. Denying visitation, calling CPS (all unfounded) and he was bringing home less than $100 a week after non-arrears matriarchy, err I mean “child” support so no chance of fighting her for contempt in court.

You should watch Dear Zachary and read the book Divorce Poison. You won’t though because you advise your clients to do the very same tactics in custody battles. More cash for you. Don’t know how you sleep at night.

Hey idiot. She had an ECTOPIC PREGNANCY. She needed surgery or she would DIE. Can’t get permission for surgery if the PARENT doesn’t give it.

Clearly she did not have the judgment to make intelligent decisions because without surgery for the etopic pregnancy, she would die and I'd bet that surgery required the parents permission.

So what's he supposed to do? Give his permission for surgery that he is told he can't know anything about? PAY for surgery he can't know anything about?

Too bad for the girl but although she is free to make her own choices, she is not free from the consequences of that choice.

And clearly she was NOT mature enough to make wise life and death decisions, thus reinforcing what we all know; that is, 16 is too young to make adult decisions.

Well, it is an ugly business, that is for sure. None of us “enjoys” it, and it is better for everyone if all can act like adults. Still, divorce is a fact of life and it is better to divorce than keep the crazy going. Here’s the deal—the kids have brains of their own and they will figure it out, so if one or the other is a liar and a troublemaker, you may convince a kid in the short run, but you won’t in the long run.

Well, dude, if you are the physician you can tell him she needs surgery or she will die, right? And if I heard that, and if I trusted you, I would say, then do it. You gave him information you admit you shouldn’t have, hinted at what the facts were and then he went in and “broke” his daughter (your word, not mine) who needed surgery or she was going to die. Nice.
