The Evidence That Could Doom Red Sox in Cheating Scandal

Doom them? The Astros didn't lose their World Series title, they just fired a manager and a GM - every team in the majors would take that for a title. The Red Sox aren't going to be doomed - they might need to make some front-office changes.

If Rob Manfred wanted to bring some credibility to this, he'd strip the teams involved in cheating of their titles.

So, what will they do? Strip the MLB championship from them? Is there is a precedent? The most I know about MLB is that the Orioles perpetually suck, and only from a ‘home team’ POV.

In Baseball, sign stealing and attempted sign stealing is as old as the sport itself. There are three main sign stealing categories in Baseball.
1) successfully stealing AND concealing.
2) successful stealing AND getting caught.
3) unsuccessful sign stealing. Caught or not.

Well, as an attorney, my good friend, let us remind ourselves how Evidence is most predominately defined:

Rule 401 (FRE’s Test for relevant Evidence) states that Evidence is relevant if: it has any tendency to make a fact more or less probable than it would without the Evidence, and, the fact is of consequence in determining the action.

As such, there are three key elements to consider if Evidence is relevant: (i) Any Tendency, (ii) More or less Probable, and (iii) is of Consequence.

In view of the information given in the mrigal post, I do not see how this information meets the criteria to be Relevant Evidence. That said, Rule 403 (FRE’s) allows a Judge the latitude to make such a determination.

What doom? They already fired the manager. The league isn’t going to NCAA and vacate any wins. Everything else is just paper nobody cares about.
