FRESNO, Calif. -- A California mother is outraged after she says her son, who has autism, was placed in handcuffs instead of being taken to the hospital.

Those questioning whether those with Autism are above the law are missing the point: No crime was committed. The 911 call requested EMS. Police will respond to calls like this if they are closer than EMS.
Given the fact that this was CA, they probably assumed an immediate OD and thought he was being combative just because, not knowing or believing that he had a neurological condition. The video probably clears that up a little, but it wouldn’t load for me.
I had a doc in the ER see my dialysis access and assume that I was a heroin addict, and I was in for chronic nausea, vomiting, and dehydration. I was 21. As minor as that was, it was infuriating to me, so I can only imagine how this family feels.
********
Moving forward a few millenniums is that still that way today?
Did he have a medical alert bracelet?
My daughter has seizures. I’d be livid if that happened to her!
Should he have to? Why? Should everyone have to wear a “I’m a good guy don’t shoot me” sign to keep from having their basic constitutional rights violated or being shot dead every time there is a LE interaction?
It’s out of hand...
In the video you can hear a woman speaking what seems to be Spanish...yet the article quotes her as if she was speaking English....
No, Humblegunner didn’t miss any point.
This is just his typical reaction to most things and he generally doesn’t think a crime is required unless he gets enough pushback on a thread to make him change his mind.
Did he have a medical alert bracelet?
*****************************
Very good question.
From the report, the teen did nothing wrong. He was in the bathroom when he had a seizure. They called 911 but the cops showed up before the paramedics.
And the police obviously didn’t know how to deal with this situation.
Why are you assuming there were any grounds for arrest or handcuffing at all?
It is true that people coming out of a seizure can be confused and combative. The police are not supposed to arrest such a person; they may need to restrain him so that EMS can treat. It might be better just to give him space.
There is no report here that he was combative.
He had his mom there who had called the ambulance and was attempting to explain the situation to the police who beat the ambulance to the scene.
“Should he have to? Why?”
You don’t know why?
“Should everyone have to wear a Im a good guy dont shoot me sign to keep from having their basic constitutional rights violated or being shot dead every time there is a LE interaction?”
ROTFLMAO!
"Certificate of Release", ha! No doubt, they had her sign it too. "Here, sign this certificate of release please. It just says we are releasing your son". Had she read it, she would have seen she was releasing the Fresno PD from liability.
As a wise person once said, "there are few bad situations that can't be made worse by calling the police". At least the boy survived.
If you were seizing should you be arrested?
Autistic people are no better & no worse. They are people.
Is a “5150” hold/evaluation technically considered an arrest? (Not saying that is what happened in this case...just always wondered).
What?
So having a seizure is illegal? Are you always an idiot?
“Did he have a medical alert bracelet?
*****************************
Very good question.”
Why should he have to? Why should anyone have to?
Since when did this become law to prevent violation of your rights?
Have you heard or read of stories of people with autism? He also had a seizure at the time. Is an appropriate response to arrest him?
Yes it is still illegal in the Roman Empire.
