It’s not technically a duel, it’s an alternate form of legal adjudication. I assume she initiated the custody proceedings so it’s not like he has a choice whether she’s involved or not if he invokes trial by combat. However, since she’s a woman, she has every right to name a champion to stand in for her in the actual combat.
If he was married to a man, “Sword fight” would mean something completely different.
