A Southern California couple who said they would have aborted the wife's fetus had doctors competently performed tests showing their daughter would be born with Down syndrome reached a settlement with two medical groups and three physicians, court papers obtained Friday show.
Lawyers for the couple filed papers with Los Angeles Superior Court Judge Victor Chavez on Thursday stating that the case was resolved just before trial was scheduled to begin. No terms were divulged. More Stories
The couple filed the wrongful birth/wrongful life case in June 2015 against Axminster Medical Group Inc., Westchester Advanced Imaging Medical Group Inc. and Drs. Glenn P. Wedeen, Christopher Meilleur and Mia J. Sanders Madati. The couple had sought about $80 million.
The mother received her obstetrical care from Axminster Medical and was seen by Sanders Madati and Meilleur, according to Axminster Medical Group's court papers.
Wedeen performed a second-semester ultrasound on the woman in June 2014 at Meilleur's request, according to court papers filed by attorneys for Wedeen and Westchester Advanced Imaging.

Being born with Down syndrome is hard, but it’s really sad that an innocent baby is born with evil parents. What kind of disgusting, greedy person tries to get rich off of their child’s genetic imperfection?

Downs is genetic! It's also called "Trisomy 21" - because the 21st chromosome pair (of the 23 pairs every normal human has) is present, not as a pair, but as a triplet.
It is not, however, inherited. (I.e., the parents are usually genetically normal.)

It’s properly called a chromosomal abnormality. It occurs, it is thought, through degeneration of the ovum with age. The cell divides unevenly, causing an extra chromosome in every cell of the body of the baby.
Please do not call it genetic. Many people have been hurt by rejection by possible spouses because the possible spouse believed that a Downs child in the family was a sign of a genetic flaw.
When my mother was 39 and pregnant with my little brother, a nurse asked my mother if she wanted some additional testing. She asked why. The nurse said so she’d have a “choice”. My mom asked “a choice about what?” Then the nurse explained. My mom declined the testing saying she’d love her baby no matter what and the nurse walked out in a huff. After the nurse left, the doctor said “Good for you. I’m tired of women choosing to abort their babies.”

The story says the doctors performed a second trimester ultrasound. I don’t pretend to know much about medical testing, but it doesn’t seem to me that an ultrasound would detect Downs. What is the medical failure involved here?

Yes, I don’t understand that either. For good and ill there have been great advances made in pre-natal testing. You’re only guessing at things like sex, downs, etc. by looking at an ultrasound, but you can know for sure by looking that the genes, and that can be done very early these days, hence all those gender reveal parties, and all those murdered downs syndrome babies.
I’m sorry I don’t know the names of the tests/procedures.
