So can companies refuse to hire homosexuals?

I am so glad my mandatory full time working days are behind me. So many rules. I saw this coming over 20 years ago.
The secondhand smoke hysteria closed a lot of very nice restaurants and bars.
When I lived in Charleston, South Carolina during the 1980’s, I could even smoke my cigarettes while riding the public bus!
I recall that little bell chime on planes that signaled Smoking Lamp is now back on!!
Ahh, the good old days.

NICOTINE AND CAFFEINE ARE ADDICTIVE STIMULANTS1 and not all "nicotine users" are smokers!!
If U-Haul will not hire those who CHEW NICOTINE GUM OR CONSUME NICOTINE LOZENGES, will they also NOT hire those who DRINK CAFFEINATED COFFEE?
NICOTINE AND CAFFEINE ARE ADDICTIVE!
A GOOD attorney would argue that U-Haul's hiring guideline here is DISCRIMINATORY because it does NOT include CAFFEINATED COFFEE DRINKERS!

I’ll bet they have far more obese employees than smoking ones and obesity causes all kinds of expensive health problems. Are they going to refuse to hire the fat?

Not just smokers. The company wants a workforce that is not addicted to the drug nicotine regardless of how it is administered. I’m sure they will have no problem getting one.

I can't say I blame U-Haul for this. Once you have a law in place that requires employers to pay for medical insurance for their employees, it's only a matter of time before employers start using medical cost risk factors in their hiring decisions.
Let's see what happens when employers figure out how to steer clear of hiring people from THESE groups:
1. Homosexual men.
2. Women of child-bearing age.
3. Marijuana smokers.

When you socialize the cost, you make your lifestyle other people’s business.
We need to attack the sexual insanity this way. You just made it legal to give people HIV without their knowledge? You’re supporting spreading diseases through wild hookups? We can quarantine you and punish you as a literal threat to everyone else’s safety.

Reading some responses, and Holy hyperbole, Batman!
FRiends, if a business chooses to do this, it is their right. Insurance companies will give them a discount for doing this. If they are unable to find qualified workers because of this, they will change the policy in some manner.
Meat eaters? Come on. Guess what, many places of business already test for MJ pre-hire, and then also randomly test after that.
Simmer down folks. Either you believe in freedom and free market economy, or you don’t.

Tobacco Farmers are being hurt by the Anti-Smoking Bulls_it. Growing up, my friend's family had a tobacco farm. It was a great job for me, under cheesecloth. It was hot, but great for teens.
Wish someone could research the tobacco plant, to help farmers. My friend's farmland is now homes and parkland...

U-Haul has a New Year's resolution: cut down on hiring people who smoke. The moving company said that it won't hire nicotine users in states where it is legal to do so, saying that it wants to ensure a "healthier workforce."
So "nicotine-users", not just smokers. Is this including people who suck on their vape things? What about those who dip or chew? None of those are taking 15min smoke breaks. And vaping is supposedly 'healthy'.
How does the company enforce this? All someone has to do is say 'no' when asked if they smoke. That's my default answer anyway nowadays. If they aren't smoking on company time, how's the company even going to figure out they 'lied'? Are you subject to firing if they discover later that you do smoke? Or, at that point, are you grandfathered in, since now you already work there?
