In a move towards a healthier workforce, U-Haul has announced that the company will soon no longer employ nicotine users in 21 states, including Massachusetts.
The chosen states are the ones where it is legal to decline a job to nicotine users. Once the policy goes into effect, applicants will be asked about their nicotine use. In states where testing is allowed, applicants must submit to a nicotine screening.

Not that I can think of. Demanding that work be compensated (which they already claim to do) is all I can think of at the moment.
I make it a practice to not click on undefined links unless I have some idea what is at it. Got burned a time or two over the years by doing that.

99.99% of “nicotine users” are addicts. I wish them well.
Probably not a wise move considering the current employment environment. FWIW, nicotine users consume far less health care dollars than Sodomites.
Getting a snake tattooed on your face or fifteen piercings is a choice too.
Yet there is a movement to restrict employers from not hiring those people on grounds of “cultural bias” (i.e. RAAAAAAAAACISM).
We could end up with a situation where you can refuse to hire the guy who smokes two Winstons a day but not the purple haired circus freak.

The thing that I think is VERY unfair about that, is that the alcoholics and obese non-exercisers are not charged “extra”. It can get pretty complicated.

Totally agree, but the comparison is a little off. After all, there is absolutely no reason to smoke (well, some could argue for medical marijuana) yet everyone has to eat to live.
AND, cheeseburgers on a Paleo diet are great! ;)
I know a local hospital that also does some sort of testing (liver enzymes??) to check if people are heavy drinkers before they are hired.

We have to do Biometric Screening every year. You have to pass 3 out of 5 criteria, or else you pay more for health insurance: Weight, Blood Pressure, Fasting Glucose, Triglycerides, and HDL Cholesterol.
It's called "At Will Employment".
Do I agree with the inherent philosophy of the law? Yes I do since it was designed to allow an employer to discharge any employee deemed insufficient in their job or a threat to the company.
But now you're advancing into an employee's personal life and their habits and taking it upon yourself to determine whether or not those habits are acceptable to your own personal standards. In other words, you're making it personal.
At Will laws were designed to benefit the employer but like every law out there, it will be abused and in this case, the employee will ultimately be unfairly screwed by their boss who just happens to be a Nico Nazi............
Do you agree that U-Haul has the right to either discharge an employee who drives a Ford or decline a job applicant simply because they drive a Ford?
