SALT LAKE CITY A Utah woman charged with a crime after her stepchildren saw her topless in her own home is fighting the case that could force her to register as a sex offender, citing a court ruling that overturned a topless ban in Colorado.
Attorneys for Tilli Buchanan argue that the law is unfair because it treats men and women differently for baring their chests. They are asking a judge to overturn her misdemeanor lewdness charges and declare that part of the law unconstitutional.
Prosecutors counter that nudity is commonly understood to include womens breasts in American society and that courts have upheld laws based on morality.
Judge Kara Pettit heard the case Tuesday but said it was too important of an issue to decide immediately. She plans to rule in the coming months
When the children, ages 9 through 13, walked in, she explained she considers herself a feminist and wanted to make a point that everybody should be fine with walking around their house or elsewhere with skin showing, her lawyers said in court documents.
Buchanan was charged with three counts of misdemeanor lewdness involving a child in February. It came after child welfare officials began an investigation involving the kids that wasnt tied to Buchanan and the childrens mother reported the incident to authorities because she was alarmed.

I read the article to see if the reason this even came up was because of the guy’s ex. Yep.
It was in private. If all that was done was them being seen, I really don’t see how the state can be involved in this. It was private property and not “public”.

So, the husband has remarried a woman young enough to be his childrens older sister and she likes nudity. Im with the ex-wife on this. Totally inappropriate in a 13 year old boys presence. And sooner or later women are going to have to admit that breasts are objects that stimulate sexual desire. Mens chests might too, but Ive never heard of a woman immediately being overcome with desire after seeing a man go topless.

Unless she was behaving lewdly simply having her breasts exposed in her own home seems rather harmless. What about breastfeeding in front of children in your own home? What about sunbathing topless in your own yard (with privacy fencing)? I can think of plenty of times a child might see partial nudity in perfectly innocent scenarios.
I have legal advice for this woman. Claim you gender identify as a man. End of case or she can claim harassment in federal court.

My parents were in all kinds of dress or undress as I was growing up.
Didn’t scar my conscious or soul.
However, they are really, really old now and seeing them in anything but clothes would definitely cause me to lose my eyesight and bark like a mad dog at any sound, day and night...

This is ridiculous.
Not that I think what she did was OK by any means, but when you consider what is being pushed on kids in public schools in the way of sex ed curriculum, going after someone as a sex offender for this at home is ridiculous.
