AURORA, Colorado (CNN) - A Colorado police officer is on administrative leave after shooting an armed man in the buttocks though the window of the man's house, according to the Aurora Police Department.
Police went on the night of October 10 to a home to talk with a suspect in an aggravated physical assault case, according to Aurora Police and a probable cause affidavit obtained by CNN affiliate KDVR.
When the officers arrived, they say they encountered Andrew Huff, 22, standing next to a truck outside. As officers in uniform approached the house, Huff fled indoors. He then looked out a window of a well-lit room as a responding officer waved at him, police said.
"The officer was certain Mr. Huff saw her and recognized her as a Police Officer," police said in a statement.
Officer Alexander Ord shot at Huff, striking him in the buttocks, the affidavit states. Huff did not fire the shotgun and no officers were injured, the affidavit says.
On the way to the hospital, "Huff made several spontaneous utterances to include saying he just saw people (approaching the house), didn't know who they were and got shot," according to the affidavit.
Huff maintains the officers did not identify themselves before firing into his home, his attorney, Birk Baumgartner, told CNN.
"Huff saw someone sneaking through his yard, so he locked the door, retrieved his shotgun, and as he was looking out the window, he saw somebody move in front of the window," Baumgartner said. "He turned to grab his phone to call police and was shot in the back."

If he were brandishing the shotgun at them, I could possibly see shooting him. But if you have to shoot through windows you’re probably not in real danger and not likely in a good position to making a shot in the first place.

At least nobody got murdered this time.
So I'm sure the officer could clearly see the shooting victim, but the shooting victim probably could not make out a police uniform.

Hard to know what all was going on at this point. The police had been out there earlier in the day on a “aggravated physical assault” and apparently the guy was a suspect.
They were confused and thought the instructor was saying “center ass” instead of “center mass” when they went through the academy.
What the heck? Keep yer finger off the trigger unless you are ready to shoot. I’m thinking accidental discharge until more facts come out.

Right to keep and bear arms. Right to be secure in person house papers and effects from unreasonable searches and seizures. I see at least 2 violations of constitutional rights here. You may argue that he wasn’t keeping or bearing arms because he was holding or displaying his shotgun and you may also argue that he wasn’t being searched or seized but those arguments are why constitutional rights are only respected in the case of outright criminals. For ordinary people the constitution is rather an inconvenience and the words must be properly parsed. Also the fact that the police had been there earlier over some potential violation of the law does not negate his rights. The reason BLM came into being was because the people who become police officers are not being taught to restrain themselves only to justify the use of their many weapons which are quite fun to wield against the defenseless.
