Dallas man went back to bed after killing burglar, police say

James Michael Meyer was charged with murder in the shooting at his home.

Authorities say a 72-year-old Dallas man fatally shot a suspected burglar behind his home and then went back to bed before finally calling police nearly two hours later.

The Dallas Morning News reports that James Michael Meyer has been charged with murder in the Thursday killing and was jailed on $150,000 bail as of Friday.

Wait - doesn’t Texas permit defending your property with deadly force???

(a) A person in lawful possession of land or tangible, movable property is justified in using force against another when and to the degree the actor reasonably believes the force is immediately necessary to prevent or terminate the other's trespass on the land or unlawful interference with the property. Burglar shot outside the home did not present an immediate threat.

When I'm a juror he most assuredly does.And I don't give a rat's hindquarters what some judge might tell me during "jury instructions".

During jury selection in Florida, judges read the pertinent law and ask potential jurors if they disagree.

Those who raise their hands are dismissed. It kinda’ takes care of nullification.

He didn’t know whether he hit the person so he went back to bed,
an arrest warrant affidavit said. After sunrise, he said he saw the
person lying on the ground.

No “premeditated murder” is premeditated.
Murder doesn’t have to be premeditated.
But murder does connote an unlawful motive.
Self defense is a justifiable homicide not murder.
Acts of war is justifiable homicide as long as the war is just.
Killing someone breaking into your house in Texas is justifiable homicide in Texas.
Defense of property gets into a grey area.
In Tennessee, I’ve been told by officers that you have the right to use the minimum force necessary to bring a thief to justice, up to and including deadly force.
But you’ll probably have to prove that was the minimum force necessary.
Not trying to apprehend someone and just shooting them dead who is stealing your possessions is murder.

Without reading the article and some of the comments. My guess...
He probably didn’t realize he hit the guy.
Thus the good nights sleep.
Probably should have called the cops anyway.
If he knew the thief had been hit and didn’t call the cops, that would be murder.
If he shot him in the front, he probably has a good defense.
If he shot him in the back, he’s probably in for a trial, but it is Texas, he will win, if the stress doesn’t kill him.

The affidavit says Meyer’s wife called an attorney for advice before her husband called 911.

Meyer refused to answer the 911 dispatcher’s questions, the Morning News reports, apparently stressing he was the victim of a crime.

The Morning News also reports that Meyer told police he threw the bullet shell casings in the trash.

Thats sounds like murder folks!

Yes,I've researched jury nullification quite extensively and I'm a *huge* supporter of it...as were many of this country's earliest legal scholars.

So,if asked that question I'll be damned if I raise my hand...because the judge does not,in fact,have the authority to ask it or to expect an honest answer.
