Trump Will End California's Authority to Set Stricter Auto Emissions Rules

WASHINGTON -- The Trump administration is expected on Wednesday to formally revoke California's legal authority to set tailpipe pollution rules that are stricter than federal rules, in a move designed by the White House to strike twin blows against both the liberal-leaning state that President Trump has long antagonized and the environmental legacy of President Barack Obama.

The announcement that the White House will revoke one of California's signature environmental policies will come while Mr. Trump is traveling in the state, where he is scheduled to attend fund-raisers in Los Angeles and Silicon Valley.

The formal revocation of California's authority to set its own rules on tailpipe pollution -- the United States' largest source of greenhouse emissions -- will be announced Wednesday afternoon at a private event at the Washington headquarters of the Environmental Protection Agency, according to two people familiar with the matter.

A White House spokesman referred questions on the matter to the Environmental Protection Agency. A spokesman for the E.P.A. did not respond to an email requesting comment. Xavier Becerra, the attorney general of California, wrote in an email: "California will continue its advance toward a cleaner future. We're prepared to defend the standards that make that promise a reality."

a comment on the article states CA can have a waver and that person provided the following info:

 CA may be granted a waver if they meet the following criteria:

According to the Clean Air Act Section 209 – State Standards, EPA shall grant a waiver unless it finds that California:

  • was arbitrary and capricious in its finding that its standards are in the aggregate at least as protective of public health and welfare as applicable federal standards;
  • does not need such standards to meet compelling and extraordinary conditions; or
  • has proposed standards not consistent with Section 202(a) of the Clean Air Act.

The Operative word here is “MAY”, which which is NOT Mandatory. A Great first step to fix this hellhole

And it will eventually be overturned.

Another example is with chemicals. A brand of brake cleaner comes in two varieties a standard and a California formulation. The standard formula melts the grease and grime off metal instantly, while the California brand does nothing.

As a native Californian I agree with the Trump rule change.
CA rules make bringing in an out of state car a pain in the rear, all so liberals can ‘virtue signal’.
I can’t wait for CA to fall into the ocean....and I live here.

Yep..you’re right. I buy the good stuff a case at a time for my shop as it takes the grime off instantly. Plain cold water would work better than the CA stuff....it’s useless.

Yes ‘may’ means it’s under federal jurisdiction. California can request but they cannot mandate.

Just had an exchange on another thread on this subject and it’s a sad comment on today’s educational system that the other side thinks emissions are not part of commerce.

Because there are two types of emissions, natural and man-made.

I don’t think California or any group of same minds is going to order the Earth to stop its natural emissions. They might be buffered via engineering if feasible but I don’t think Gaia is going to listen to a bunch of California progressives complain about her emissions.

So that leaves only man-made emissions to consider. And what causes man-made emissions? Why man-made equipment of course,

And what governs standards and codes of man-made equipment?

Ans: The Federal Government via the Constitution’s Commerce Clause.

Ergo, man-made emissions fall under federal jurisdiction.

It’s really very simple to understand if one understands the Constitution which was written so that ordinary Americans could understand its meaning and intent.

So it’s sad to see some who are capable of putting fingers to a keyboard not have the grey matter between their ears to understand that California tried to usurp federal power on this subject.

This is very bad in my opinion.

We will see what we think about this when there is an assault weapon ban at the federal level, and liberals point to this as an excuse to override our local laws.

Sometimes I feel like I am the only constitutionalist. Everyone on the left and right just wants control of another. Not what the US is about.

Still waiting for “commerce clause” to explain exactly how emissions are traded and sold in interstate commerce.
