Yes ‘may’ means it’s under federal jurisdiction. California can request but they cannot mandate.

Just had an exchange on another thread on this subject and it’s a sad comment on today’s educational system that the other side thinks emissions are not part of commerce.

Because there are two types of emissions, natural and man-made.

I don’t think California or any group of same minds is going to order the Earth to stop its natural emissions. They might be buffered via engineering if feasible but I don’t think Gaia is going to listen to a bunch of California progressives complain about her emissions.

So that leaves only man-made emissions to consider. And what causes man-made emissions? Why man-made equipment of course,

And what governs standards and codes of man-made equipment?

Ans: The Federal Government via the Constitution’s Commerce Clause.

Ergo, man-made emissions fall under federal jurisdiction.

It’s really very simple to understand if one understands the Constitution which was written so that ordinary Americans could understand its meaning and intent.

So it’s sad to see some who are capable of putting fingers to a keyboard not have the grey matter between their ears to understand that California tried to usurp federal power on this subject.
