A big problem here is that the judge is a rat which was part of the plan.

Trump can release any document he wishes as declassified. This would totally blow the case against Flynn with a handful of documents that AG Barr has to get in his hands and could get released. If you want to clean out the place you have to clean out the trash. The FBI has a lot of decent people, but they have too many bad people that need their exit papers and many that need to be indicted.

Judge Sullivan was the hero in Powell’s book disclosing the prosecutorial crimes of Weissmann. Sullivan is the judge who dismissed the charges against Senator Stephens (R-AK).

Or (b) the prosecutors can do the smart thing by dropping the charges and quietly disappearing into the witness protection program.

One, Flynn winning in court sends a powerful message to the public about Mueller misconduct and keeps this misconduct in the news.
Two, with a win, it may allow Flynn to recover attorney’s fees. It also helps Flynn recover his reputation.
Three, a Trump pardon sends a message of covering up something to some people.

Why pardon Flynn now? Powell is closing in on the corrupt Mueller investigation that will expose what happened or the judge will throw the whole case out because DOJ won’t provide the requested documents. Let Powell complete the legal process.
Trump must also consider the political consequences, which will affect the timing of a pardon, if necessary. I have no doubt that Trump will issue a whole bunch of pardons before his first term is up.
