I'm sure not all will agree, but whoever the homeowner was, he was way out of line. From the article, from the father of one of the 17 year-olds:

Javier's father Jimmy said he should not have fired his weapon because the teens were in his garage and not his house.

'It wasn’t in your house, it was in your garage.

'That’s like 10 feet away from your house, you know so that means you’re seeing some perps out there at your garage, you know, so my first instinct is to call the police,' he said.

This father is correct. Killing someone who is in your garage (unattached from the house no less), and who isn't directly endangering your life, is not justified.

Doesn’t Texas have a law that justifies that? I would’t think Ohio would.

How does the homeowner know that the intruders aren’t setting an explosive device or going to come out of there with AK47’s and storm into the house? They’re trespassing and they’re not in view in a city (Dayton) that’s on edge.

Detached Garage. That is an important element.

However, if he went out to the garage to investigate noises, and was confronted and feared for his life, that would be relevant.

This guy needs a good lawyer and must be very careful about what he says.

Everything not “inside” your home is no longer private property and now public property in common? Theft is now considered to be justifiable and deemed as salvage rights on public property? Are you one of those who still pay property taxes on your front yard and “set back” even though your municipality has deemed all front yards and set backs as public property with public access?

I would agree if that in fact is correct, but there’s not a lot of information right now as to exactly what happened. Did the boys threaten the owner and put his life in jeopardy? Better to wait until all the facts come in.

Expert witness opinion from someone who has never had their property invaded or had their life threatened..........

Being an ever increasing anti-crime advocate, if I were on the jury I would vote to acquit........

Ya gotta put a stop to this nonsense sooner or later.........

Bottom line - do not trespass on property that isn't yours. Going up and knocking on someone's door is one thing, but rummaging around in a garage that is not on your own property and that you were not given permission to access means that anything goes. Should the owner have shot at them? Doesn't matter, the two "teens" didn't belong there. Frankly, there is a segment of our society that needs to have the concept of property rights drilled into their heads as they clearly don't respect that concept.

Someone in my barn..or in my garages....looking to hurt me steal from me...or mine...is getting one warning...

They come at me...I'm shooting.

To shoot them with no warning,,,if they are unarmed..is wrong.

Your right. He should’ve handed them a three page questionnaire on what their purpose for being there was and their armed state as well as their personal fitness level as to how lethal they might be with bare hands (which are used in most murders). Only after they filled that out and he cross examined them about it could he be 100% certain that lethal force was justified. The whole process should not have taken more than 15 or 20 minutes.

You’re assuming the homeowner was inside his house. Could be he was out in the garage tinkering around like many men do and they came at him.

Don't agree (Since my right to free speech is guaranteed by the First Amendment.)...

I'm just hoping he used the old "double tap" to send Devon and Javier on their way to the coroner's lab... IAC, there is a high probability that that is where they were destined/training to, ultimately, get to...

So he should have let them steal him blind...And when they had cleaned out the garage, then the house, eh??? In my view a homeowner has every right to protect his property...
