Ohio homeowner shoots dead two 17-year-old boys who were 'trespassing' inside his garage at night

An Ohio homeowner shot dead two teenage boys who he say were 'trespassing' on his property on Wednesday night.

The homeowner has not been named but is being questioned.

He told police that on Wednesday at 9.30pm, he shot the two boys in his 'garage'. He called 911 afterwards.

The boys have been identified as 17-year-olds Devon Henderson and Javier Harrison. It remains unclear if they were trying to break into the property, or what their motive for being there was.

When the homeowner called 911, he told the operator: 'I shot two guys. I shot two persons tried to rob… to do something in my house.'

Dayton Daily News, a local outlet, says one of the teenagers' father's believed they knew the shooter and had been in the garage before.

I would advise him to get his affairs in order in any case. However, even playing the 911 tape may only lead to reasonable doubt and not beyond it. As others have said, he was outnumbered, 3 to 1. He may have feared for his life.

If you have it clearly posted as private property, this should be the default assumption of those trespassing. Around here you see a lot of signs posted that say “If you can read this sign you have already trespassed onto private property without permission and are right now in rifle range”.

If you go past this you are an idiot and deserve every bit of it.

A homeowner called 911 around 9:30 pm to report he had shot two people in his garage in the 800 block of Conners Street.
Police say the resident heard noises outside of his home. When he went outside to investigate, he saw a light coming from a car in his detached garage.
He encountered three people in the car and fired several shots from a .38-caliber revolver, killing two of the car’s occupants. Chief Biehl could not confirm if the teens were shot while they were still inside the car.
The third occupant fled the scene.
Police confirmed Thursday that drug activity was occurring at the time, but say it remains unclear what the teens were doing or intending to do with those drugs.
The homeowner then called 911 to report the shooting. When police arrived, he was taken into custody for further questioning but has since been released.
Once police and emergency crews arrived, the third person returned to the area and was subsequently arrested for breaking and entering.

“Don’t nobody hang in there, because that gate is always locked. There’s a chain on there. Only time that gate is open is when he sets his trash out or to cut his grass,” Smith said.

No. It apparently doesn’t. It opens into his back yard, with a chained gate in a 6’ or so high fence.

The police will sort it out. However, no where on the tape did he say or from what was shown indicate that he was in fear of his life. And he freely admitted using deadly force. His story, as reported has too many inconsistency. I read the article at least four times and could only find the mention of two subjects. Where did the third individual come from and where did he go?

It depends on the state. Texas is probably the friendliest. Ohio is down near the bottom. You HAVE to know the laws in the area to which you are speaking.

The two teens shot and killed Wednesday evening have been identified as
Javier Harrison and Devon Henderson, according to Montgomery County Coroner
Dr. Kent E. Harshbarger. Henderson and Harrison were both 17 and from Dayton.

We need to form a common sense club. Your post is spot on and it’s scary to see how many seem to not fully comprehend the consequences of even a justified shoot, much less a borderline or bad shoot.

Man, that was good. If I may, I would like to add that one cannot instigate the event [confrontation] then claim the protection of the law. a guy in Florida thought he could do that. A Jury informed him that was not the case.

No, he should not have let them ‘steal him blind’. He should have immediately called the police, and protected his family and himself from bodily harm - using his weapon if necessary for this purpose.

I grew up in an atypical household, and often didn’t have much supervision. That’s not my fault, as no kid chooses their circumstances. Looking back, there were probably multiple times when I could have been shot as a kid for getting into some of the things I did - even at 12 years of age. I’m lucky and grateful that the adults I encountered when I was young and oblivious didn’t shoot and kill me.

Feel free. It helps to illustrate how the slightest error in judgement can cause one who believes he is legally defending himself to instead become a lawbreaker.

And to all of the rants here about private property and trespassers.... when you step out your front door, regardless f how much land you own, whether a half acre lot in town or a 1,000 acre ranch, the laws are much more restrictive.

Know the law in your state. Texas law might make more sense and appeal to us, but unfortunately it applies only in Texas.

Also, you mentioned so many inconsistencies. I’m not completely sure that the confusion isn’t partly due to such poor journalism and reporting that we see on a daily basis these days. I would imagine that this will go to court, and that a jury of his peers will decide whether the shooter is guilty or not guilty.

I also wonder whether or not the third person might be charged in the deaths of his friends.

It will be an interesting case to keep an eye on.

I got that info from a caption under a photo. But I just double-checked.

The first video at that link is of the police chief. He gives the address. Google Maps shows an access road behind the garage. The second video at the link above shows the garage.

None of this excuses the teens for trespassing. But, unless there’s more to the story, it sounds as if the homeowner should’ve just called the police.
