Ohio homeowner shoots dead two 17-year-old boys who were 'trespassing' inside his garage at night

An Ohio homeowner shot dead two teenage boys who he say were 'trespassing' on his property on Wednesday night.

The homeowner has not been named but is being questioned.

He told police that on Wednesday at 9.30pm, he shot the two boys in his 'garage'. He called 911 afterwards.

The boys have been identified as 17-year-olds Devon Henderson and Javier Harrison. It remains unclear if they were trying to break into the property, or what their motive for being there was.

When the homeowner called 911, he told the operator: 'I shot two guys. I shot two persons tried to rob… to do something in my house.'

Dayton Daily News, a local outlet, says one of the teenagers' father's believed they knew the shooter and had been in the garage before.

There is a reason why I am in Az. The theory has indeed been tested and upheld many many times over the years. Only recently has the communist mentality started to infiltrate and affect these private property rulings.

It sounds a lot like the case in Montana a few years ago.
That didn’t go well for the homeowner.

Yep, You have to let them take it, because even law enforcement can’t stop them because they have no authority or jurisdiction to prevent it on PRIVATE PROPERTY. They can chase after it leaves the property though, only if they choose to at their own personal discretion.

In my county, one must get 911 on the telephone before shooting at an intruder in one’s home. Yep. Hopefully phone line is working otherwise homeowner is in trouble if it becomes necessary to shoot.

The windows on the house were boarded up, the door on the left has bars in front of it.

I think the homeowner knew what he was doing.

Ohio is different.

According to this Ohio lawyer, you are right, or at least you were right as of 2013.

According to info at the link, to be covered under Ohio's Castle Doctrine, a dwelling must be designed to be occupied at night. That does not describe most garages, attached or unattached.

The young men can speak for themselves when they come before the judge. in the mean time most people don’t want someone wondering around in their homes.

No. They might have stolen from, but they had not robbed him. What is the difference you say. About 20 years if you shoot him. This guy needs to figure who he is going to get far a lawyer at this time.

Some killings are indeed justified no doubt

He is not only going. He is going for a long time. 20 years should just start it. He may as well start packing. All the prosecutor has to do is play the 911 tape. His own words will convict him.

...But it really depends on the local/states laws as to whats considered your 'dwelling' and when you are 'justified' to shoot someone, beyond a clear threat to your life or loved one...

Any lawyer worth his salt is going to point out that the garage was a confined space and there was a disparity of numbers.

If the owner went into the garage through a man door and it closed behind him, that right there is a life threatening situation. 9:30 is after dark these days.

The report says nothing about a lawyer, but the police can not question him without reading him his Miranda rights. Either he is completely stupid, or he has had a lawyer present all the time.

First time I’ve heard that one. Seems kind of hard to justify that in all cases, though handled correctly I can see how that would help in a defense of good shooting.

I tend to agree about inside the house but this was detatched

I actually apprehended an intruder in my home at Ole Miss in 1979 summer of and I’ve told the story before here so I won’t bore folks with my usual flair for detail

I’m glad I didn’t kill him even though it woulda been justified

I had my model 28 soft tips....woulda killed him for sure

I did hit him though.

His kids came by later and thanked me profusely for not killing him

I know Freepers love a justified kill but I think it’s like watching a movie to many here especially the cat ladies

That’s the thing, if I walk into a room and there is someone else there, boy oh boy, that is frightening just to even envision. I also have to commend you for not shooting at that time. You’ve got some self control.

I tell you though, despite what I’ve said here, I don’t ever want a notch or any notches or marks on my kill stick. I don’t want that weight on my soul, justified or not.

I don’t carry my gun for this reason, and that behavior could end up getting me killed one day, but I don’t want any kills.
