102-year-old California woman evicted so landlord's daughter can move in: report

A 102-year-old Los Angeles woman is reportedly being evicted from the apartment she has lived in for 30 years to make room for the landlord’s daughter.

Thelma Smith received a 90-day eviction notice for her month-to-month lease in early March and is now relying on friends and relatives who live on the East Coast to help her find a new place to live, The Los Angeles Times reported.

The Los Angeles Rent Stabilization Ordinance says that landlords in the county can evict tenants to accommodate a relative, but they must start with the most recent resident. Smith, however, lives in unincorporated Ladera Heights where the laws are weaker. “They use this law to target long-term, low-paying tenants,” Larry Gross, the executive director for the Coalition for Economic Survival told The Times.

How do you know the landlord is elderly? And what difference does that make?

At 102, it is extremely unlikely she is living without somebody taking care of her 24/7. I suspect she has multiple other family members living in the same apartment, who are taking advantage of the low rent.

Laws must be very screwy in Cali, because a month-to-month lease, by definition, can be terminated by 30 day’s notice from either party, without cause.

The lesson here is: if you want a home forever, buy one, don’t rent. Even then, you better hope you can cover the real estate taxes that will get increased year after year.

The state laws usually treat it as an implied contract. So even though you never signed an actual lease, as soon as you move-in, by law, you are bound to a contract, since the law has determined there is this minimal contractual relationship that exists in any landlord-tenant situation.

She shelled out rent all those years when she should have been purchasing her home. Sorry, but renters are at the mercy of landlords.

To be forcefully evicted with out cause? Doesn’t matter. Folks are probably going to be sued for offending somebody with a microaggression so why not this?

That will make rental property more available exactly how?

They are forcing the landlord to provide the use of his property to a tenant at below market rates. They are stealing from the landlord.

They found an old lady getting evicted with 90 days notice, plenty of time to find another place to live.....IF there were no rent control.

They want landlords to not have a say over their property.

You are a fool for for falling for it.

The other immorality is a person living 100 years while neglecting their responsibility to own where they live.

She may have wildly spent her income and savings on recreations instead of addressing her basic need to own.

She may not have learned to delay gratification. So others are punished for her faults.

Besides, at 102 years, she will get offers for care from across America.

I’ve said before. Since this country deems it allowable to slaughter babies by the millions, it is only a matter of time before that fate befalls old folks so why worry about a 102 year old woman that gets kicked out into the street.
By the way that was in a tongue in cheek sarcasm of our society today but a lot of folks didn’t catch it.

Your premise is flawed. The woman is hardly “getting kicked out into the street”.

The entire reason this has even become a story is because the leftists want to eliminate any vestige of ownership that remains with landlords - and in this case there is a “loophole” in the unfairness of rent control that this landlord, with ample notice, is using.

The left could care less about the 102 y.o. woman.
