Can Biden run for President?

Posted on 04/30/2019 9:22:56 AM PDT by Jonty30

I thought the requirements to run for the Presidency were the same for both the President, no more than two terms in office with the only exception would be mid-term if a President dies in office?

Not that I think he has a chance in winning because nobody can beat Trump, which is why nobody but clowns are running for the Send.

If that was the case, George HW Bush would’ve been ineligible.

The rules, the law , are listed in the Amendments to the Constitution.

I say let him run. There will be bad blood between Biden and Bernie and Hillary and the other nutcases.

Hoping they come out of the primary so fragmented and frustrated with each other that they all stay home or vote for Trump in protest.

I would not want Joe Biden to be president of my neighborhood association. He is idiotic
He’s a power mad egomaniac who abuses people over whom he thinks he has power.

No. You are incorrect. In fact a VP that becomes president after the mid term election of the first term may serve a total of ten years.

He has never been president. Therefore, he could serve two, 4-year terms. Heaven help us if that would happen!

I fear that frustration and fragmentation will be so severe, that Hillary will swoop in at the last minute and “selflessly” take the nomination to unite the party. There will be great joy among the democrats. The thing that I fear in 2020 is voter fraud!

Either I'm missing the meaning of your question... OR... you forgot that George H Bush's served 2 terms as Reagan's VP before running for & serving 1 term as President and running for the 2nd term.. (Ditto for Nixon under Eisenhower.)

Have we thought about Biden running for President with Obama as the running mate, and then Biden stepping down? Flipping scary thought.

That was my understanding of Constitutional law. I thought term limits applied to both President and vice-President. That was what was explained to me.

Why does anyone think he can’t run?
Nixon was Eisenhower’s VP for 8 years he ran!
Ran 3 times won twice!

He hasn’t been the President. He’s been the Vice-President.

When questions like this come up, the best thing that you can do is to go directly to the Constitution. The answer is right there. Easy to read.

Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.

Section 2. This Article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several states within seven years from the date of its submission to the states by the Congress.

Biden has not been “elected” nor has he “held the office” or “acted” as the President for more than two years. The Vice Presidency and Presidency are two separate offices.
