The dismissal and reinstatement of charges isn’t the same as being acquitted in court, and then being prosecuted again of the same charges (stemming from the same act ... obviously, if someone robs a bank a second time, they can be charged with bank robbery again even if acquitted for the first bank robbery, and this isn’t double jeopardy).

Double jeopardy only happens if you are acquired by a court. Smollet never even went to trial. Also you an be charged with two different crimes for the same act of it breaks two different laws. In this case it sounds more like a civil court.

If Smollett committed a crime, charge him with one. If he didn't, or you don't think you can prove one, let him go. It's pretty simple. I believe it's called "due process."
