Protesters gathered outside a Cuban tourism office in Montreal to support a father whos been stuck in Cuba for over a year and faces a second trial on Monday for his involvement in a fatal boating accident.
During a family trip to Cuba in July 2017, Montreal resident Toufik Benhamiche was driving a boat that veered out of control and killed an Ontario woman. He was charged and convicted of criminal negligence causing death.
Benhamiche was released from custody after both his conviction and his four-year prison sentence were overturned by Cubas top court.
It was fantastic news for me. And at that time, I felt the nightmare was finishing, Benhamiche told CTV Montreal from Cuba.
He and his lawyer have alleged that he was given very little direction on how to operate the boat.
But even though his conviction was overturned last summer, Benhamiche was not allowed to go home. On Monday, he will be tried again for criminal negligence, after a second trial was ordered.
On Sunday, more than 50 protesters gathered in Montreal to demand the Canadian and Cuban governments do more to get him home.(snip)
Benhamiches wife, Kahina Bensaadi, told CTV Montreal that the situation has been very difficult. Although her husband isnt in jail, she said its like he is in one.
Its like if youre in jail if you cant work, you cant see your family, you cant kiss your two daughters every night, she said, adding that she doesnt trust the system in Cuba.
Its the same judges who ignored the law a year-and-a-half before, Bensaadi said. It's completely unrealistic. They ignore everything. We feel we are in the middle ages.
She said shes been forced to send him money to pay for the Cuban apartment hes been staying in.

In the majority of countries in the world prosecutors can retry people on the same charges over and over.
We’re fairly unique in that we don’t allow for this kind of thing.
What a moron. When you’re in a foreign country, especially one like Cuba, you pay a local to drive the boat. And the car, bus, rickshaw, whatever.

Drunk Canadian killed woman with his boat? I’ll wait around for a better political prisoner to support. What’s the argument? That he should be released to go home?
Europe and the former colonies of Europe, as well as most of the middle east, Use the Napoleanic Code as the basis of their legal system. In criminal matters, you are guilty until proven innocent. Sounds like the current progressices and the media would like to see it implemented here.
I know some Canadians who have been there, and they didn’t seem the least bit impressed.

Based on the article, a “Canadian” with an awfully religion of pieces name, murdered a Canadian woman due to HIS criminal negligence [blaming someone else for not teaching you to drive a small boat isn’t a defense, it’s a confession]. The victim is dead. He has been inconvenienced and rent an apartment. Boo hoo. The jerk is suing the travel agency for $340,000 for letting him kill someone. But I’m surprised the Cubans haven’t let him go altogether — lest tourist loons stay away.
There’s something disgusting about people who go to a third world Hell Hole to gawk at those being crushed under the foot of a totalitarian. There’s something even more disgusting when that person has fled a situation where the ayatollahs were doing the same to them.
