White House Suspending Jim Acosta Again

White House officials sent Acosta a letter stating they made a "preliminary decision" to suspend his pass after 14 days.

The White House will suspend CNN reporter Jim Acosta again, according to a report by CNN’s Brian Stelter.

Stelter writes:

If you thought the Trump administration would seek to settle CNN and Jim Acosta’s lawsuit out of court… think again.

After CNN won a temporary restraining order on Friday, forcing the White House to restore his press pass for 14 days, White House officials sent Acosta a letter stating that his pass is set to be suspended again once the restraining order expires.

From the looks of the letter, the W.H. is trying to establish a paper trail that will empower the administration to boot Acosta again at the end of the month.

Sheesh! That letter to Acosta lays out instructions on how to contest the suspension. That sounds like.....DUE PROCESS to me!!

What in hades was this judge smoking?

Regardless of what the judge was smoking, snorting, or injecting, he should be removed from the bench.

That was my first thought, too. It’s a shame we have to spell out such common sense rules of decorum and good conduct like this. But Democrats simply cannot be trusted to act as responsible adults. Ever.

As I understand it CNN’s suit alleged infringement of first and fifth amendment rights. The judge ruled that Acosta’s fifth amendment right to due process was violated and issued a two week restraining order without ruling on the first amendment claim. The White House established rules in writing to satisfy the due process claim but wants a ruling on first amendment grounds which they think they can win as Acosta’s right to free speech was not abridged. We’ll see, but to most of us it’s a no brainer.

I wish Trump would stop bowing to the courts. They had no jurisdiction over this anyway.

That is exactly what I have been telling people whenever I have commented on this topic. It is ridiculous to believe that the Judiciary has any authority over the conduct of the Executive in the White House.

So far as I'm concerned, the President has the right to kick off anyone he wants from the White House grounds.

The courts have no jurisdiction over matters of the executive branch.

Hard pass was stripped without due process (Or lack of Plausible explanation which is judicial tyranny and a horrible opinion based on the actual process of who and how the passes originate from).

Problem I have with the judge's ruling is that reporters operate under privilege, not rights, when issued a hard pass to the WH (And SHOULD be uninvited at will without explanation). Another private outlet issues a press pass (Congressional) which remained.

These press conferences are a waste of time anyway. Reporters are contrarians to those they don't like and become obedient journalistic whores to those who they do like. The end game is that an objective analysis is not made, hence this façade has no journalistic integrity at all.

The judge was following a DC Appeals Court decision rendered in 1977 in Sherrill v Knight. As a judge of that District Court, he had no choice.

Judge Kelly showed the way to handle 5th Amendment issues inferred to exist in Sherrill v Knight. Acosta has been informed that he's on the clock to have his pass removed for cause with the opportunity for White House administrative review. I don't remember my post talking about a win. I was pointing out that judge Kelly might be getting undeserved criticism. This decision was above his judicial pay grade.
