In New York and in most, if not all, jurisdictions it is in fact settled law. An engagement ring is a conditional gift. Absent a subsequent marriage it is not hers to keep. Doesn’t matter who broke it off. This is not an unusual case, just the size of it.

FindLaw .com does not agree. She gets to keep it only IF it was a gift for a specific occasion. But not if it was a promise to marry.
Depends upon the state. In some places it is considered a conditional gift with the condition being marriage. That can also be nullified if you give the ring as part of a gift for another gift giving reason like Birthday, Christmas or Valentines Day.
